Plaintiffs (property owners) alleged that the defendant (property manager) overbilled and falsely charged the property owners for repairs and other expenses. Defendant denied any such wrongdoing and provided financial records and other supporting documents to demonstrate proper billing procedures and charges for approved expenses., 2022
- 656 Hermitage Circle, LLC v. Wallach, Case No. 1:22-cv-0057-LGS (S.D.N.Y.) The court dismissed the case based on Defendants Motion for Judgment on the Pleadings. Plaintiff brought the lawsuit against Defendants seeking to enforce guarantees that Defendants executed to secure a loan. The lender, however, had discharged and released the principal mortgagor and borrower. Accordingly, Defendants successfully argued that the guarantors must be discharged because of the payment or satisfaction of the principal obligation., 2022
- Dixon et al. v. Caesars Entertainment Corp., et al., Case No. 1:21-cv-01673 (N.D. Ill.) My firm represented plaintiff in a wrongful death action against defendants who operate Harrah's Joliet Casino and Hotel. The parties settled the case on favorable terms to plaintiff. After plaintiff successfully opposed various pre-trial motions and the parties engaged in significant discovery, they reached a settlement., 2022
