Attorney Profile

John D. Waller protects the interests of lenders and loan servicers, as well as commercial borrowers and guarantors, when there has been a default on a secured loan. He acts as an advocate during the workout of underperforming deals. In cases of nonperforming loans, John files and defends lawsuits to enforce promissory notes, guaranties and other written contracts. He is familiar with receiverships, and he understands how to foreclose on real estate mortgages and enforce personal property security interests. John also preserves lien rights for creditors in bankruptcy court.

In addition, John provides counsel to lenders and investors seeking to sell or purchase distressed loans. He also asserts the rights of creditors and other parties in complex, real estate-related litigation. John frequently serves as a responsive and cost-effective local counsel for out-of-state lawyers whose clients need to foreclose liens within Indiana.

An AV Martindale-Hubbell Peer Review Rated lawyer and partner at the Indianapolis law firm of Wooden McLaughlin, John graduated from DePauw University in 1990 and immediately entered the Indiana University School of Law. In 1993, he received his license to practice in Indiana’s state and federal courts. John later completed an intensive week-long professional training program in trial skills presented by the National Institute for Trial Advocacy. John has represented companies and individuals in a wide variety of disputes. He has tried a number of bench and jury trials, and has handled several appeals.

John leads the Zionsville All-Pro Dad's Day breakfast program. He and his wife Dena have three sons.

John publishes the blog “Indiana Commercial Foreclosure Law” at http://commercialforeclosureblog.typepad.com.
