Justin C. Kuhn is a partner at CohenMalad, LLP, in Indianapolis, Indiana, where he focuses his practice on personal injury matters, with particular attention to medical malpractice and nursing home negligence claims. Mr. Kuhn’s foundation in appellate work began with a clerkship for the Honorable Cale J. Bradford of the Indiana Court of Appeals, an experience that sharpened his legal research and appellate drafting abilities. He has since authored numerous appellate briefs across a spectrum of issues, including medical malpractice and insurance coverage disputes, and brings that appellate perspective to trial preparation and post-trial strategy.
Before joining CohenMalad, LLP, Mr. Kuhn spent time defending health care providers and insurance carriers against malpractice, personal injury and property damage claims. That background provides him with practical insight into common defense theories and litigation tactics, which he uses to anticipate opposing positions, refine case theories, and pursue effective negotiation or litigation pathways on behalf of plaintiffs.
A graduate of Indiana University Robert H. McKinney School of Law, Mr. Kuhn earned his J.D. with honors, and he completed his undergraduate studies at Indiana University with a B.A. in political science, also graduating cum laude. During college, he was a four-year letter winner in wrestling, an experience that instilled discipline and a competitive drive he carries into his legal work. In recognition of his advocacy, he was a 2023 Trial Lawyer of the Year nominee with the Indiana Trial Lawyers Association.
Active in the legal community, Mr. Kuhn maintains membership in the Indiana Trial Lawyers Association and the Indiana State Bar Association, participating in forums that advance practice development and client representation. He is admitted to practice in the State of Indiana and before the U.S. District Court for the Southern District of Indiana, and he applies that broad admission base when selecting venues and shaping litigation strategy.

- Neter-Nu v. Methodist Hospital et al., 45D11-1809-CT-00541 (Lake Co. Sup. Ct., Ind.); Abbas v. Neter-Nu, 261 N.E.3d 233 (Ind. 2025) Obtained $11 Obtained $11 million verdict for client in a two-week medical malpractice trial involving negligent placement of a foot IV and a failure to diagnose an ischemic injury resulting in a below-the-knee amputation. The case then went up to the Indiana Supreme Court, where plaintiffs prevailed on all issues., 2025
- Cardiology Associates of Northwest Indiana (Ind. 2021) Justin was part of the legal team representing patients in hundreds of medical malpractice claims alleging that cardiologist Dr. Arvind Gandhi and his colleagues at Cardiology Associates of Northwest Indiana P.C. performed unnecessary cardiac procedures on patients. The litigation ultimately resolved through a $66.5 million settlement covering 262 claims, one of the largest medical malpractice settlements of its kind in Indiana., 2021
- McDaniel v. Robertson, 83 N.E.3d 765 (Ind. Ct. App. 2017) Justin served as primary brief writer in successfully representing the Patient’s Compensation Fund in a medical malpractice appeal concerning the appropriateness of the trial court’s damage award., 2017
- $7.3 million medical malpractice settlement for a Kentucky patient who suffered a spinal cord injury resulting in complete paralysis during the replacement of her spinal cord stimulator.
- $2.264 million for victims of pediatric surgical malpractice was obtained in total combined settlement against an Indianapolis pediatric surgeon. The doctor performed multiple surgeries on children for cleft lip and palate treatment, resulting in significant and permanent damage to his young patients.
- $1.75 million wrongful death settlement for a patient who underwent an upper GI and colonoscopy resulting in a 2 cm laceration of the spleen. The patient started experiencing symptoms after being discharged home and called the after-hours hotline to report the problems. The on-call physician failed to respond to multiple telephone calls from the patient’s family, ultimately resulting in the patient’s death.
- $1.675 million infant wrongful death medical malpractice settlement for hospital staff’s failure to properly monitor fetal heart strips and manage patient’s labor, resulting in the death of the newborn.
- $1.65 million wrongful death settlement for the family of a patient who suffered a fatal cardiac event while at a local Indianapolis hospital. The hospital had outsourced telemetry monitoring to an off-site contractor, leaving all alarms silenced. As a result, lifesaving care was delayed, CPR was not administered for over eight minutes, and the patient died.
- $1.475 million medical malpractice settlement on behalf of a patient injured in a coal mining accident that fractured several ribs. During surgery to remove the damaged rib, the physician mistakenly removed a healthy, uninjured rib.
- $1.375 million retained foreign object settlement for a patient who underwent exploratory surgery after an abdominal mass was identified, and was discovered to have a retained blue surgical towel after a cesarean birth. The patient required small bowel resections, the removal of part of her small intestine, as well as repair of the colon.
- $1.265 million cardiac malpractice settlement was reached on behalf of a patient with a prosthetic heart valve who underwent an ultrasonic periodontal cleaning. The dentist failed to prescribe prophylactic antibiotics prior to the procedure, leading to the patient developing infective endocarditis (“IE”) and bacterial vegetation forming on the prosthetic valve, ultimately requiring replacement of the damaged prosthetic aortic valve.
- $1.2 million cardiac malpractice settlement for a patient whose physician failed to diagnose and properly manage a myocardial bridge. Instead of using conservative treatment, the physician placed a stent, resulting in a laceration of the patient’s left ventricle and causing permanent heart damage.
- $1.2 million cardiac malpractice settlement against an Indiana Hospital for failing to provide treatment for 45-year old patient’s infected heart valve (endocarditis) despite repeated ER visits and knowing of patient’s artificial aortic valve.
- $1.137 million retained foreign object medical malpractice settlement for physician’s failure to completely remove a previously placed drain with a 4 cm piece of a drain remaining in patient for over 4 ½ years, causing ongoing pain and scarring.
- $1.132 million medical malpractice settlement on behalf of a pregnant patient whose repeated complaints to her OBGYN physician and emergency room providers went unheeded. Her appendicitis went misdiagnosed for over five months resulting in a ruptured appendix, a large abscess, an enteric colonic fistula, multiple surgeries, a colostomy, and JP drain placements.
- $1.125 million dental malpractice settlement involving a wisdom tooth removal resulting in damage to the inferior alveolar and lingual nerves and a retained metallic object which required surgical extraction.
- $1.035 million medical malpractice settlement involving a physician performing an unindicated cardiac catheterization and subsequent unnecessary implantation of a cardiac stent, which resulted in a sizeable, difficult-to-control hematoma developing at the cath insertion site.
- $1 million medical malpractice settlement against the VA Hospital involving a patient who underwent surgery of the L3-L4 vertebral space performed by a resident which resulted in a cerebrospinal fluid leak and sacral nerve root injury.
- $762,500 dental malpractice settlement for a young patient who suffered negligent dental care over 13 years, resulting in infections, bone loss, tooth decay, tooth loss, and permanent damage to existing teeth. The patient required extensive, invasive dental treatments, incurred significant dental expenses, and experienced both physical and emotional harm.
- $700,000 dental malpractice settlement for a patient whose jaw was fractured during the extraction of an impacted wisdom tooth. The fracture required emergency surgery to repair the injury.
