Attorney Jenna L. Verdicts / Settlements (Case Results)
- Sidewalk fall brings $95,000 settlement on a spring day in April, our client was walking her dog when she tripped and fell on a raised section of the sidewalk. She suffered a fractured arm and underwent two surgeries. Hupy and Abraham argued that the tree next to the sidewalk shaded the sidewalk, and our client did not see the raised portion of the sidewalk. There was a dispute between the city and the property owner as to who was legally responsible for maintaining the sidewalk, 2022.
- $135,000 (total of work comp claim, third party, and UIM): A motor vehicle accident occurred while working. The workers’ compensation claim settled for $25,000.00 new money, the third-party liability carrier paid policy limits of $50,000.00, and the UIM carrier paid $60,000.00 new money. I negotiated with the workers’ compensation carrier to reduce its lien against the third party from $61,915.66 to $16,666.67. This was the only significant payout from the settlement proceeds. My client sustained a right shoulder rotator cuff strain and labral tear, as well as back and neck pain. He had a history of back surgery two years prior to the accident. The client was extremely satisfied with the settlement, 2017.
- $250,000: Defendant driver lost control of his vehicle. The client sustained an ankle and wrist fracture and underwent a laminectomy at L5-S1. His paid and outstanding medical bills were approximately $33,000.00. He had a decent recovery with intermittent back pain and discomfort.
- $15,000: Client sustained minor soft tissue injury with less than $1,500.00 in damage to her vehicle. The client experienced neck, back, and right shoulder pain and was treated for 3 ½ months. Her paid and outstanding medical bills were less than $1,000.00 in 2018.
- $135,000: This is a workers’ compensation case. My client was a passenger in a semi‑truck when the driver passed out, lost control, and rolled the semi‑truck. My client was ejected from the truck in the collision. He was noted to have “Fairly minor injuries” in the ER. He has a significant prior medical history of low back pain, foot drop, and sciatica and prior workers’ compensation claims. The defense medical examiner did not see any objective changes to prior imaging and felt the back pain complaints were subjective in nature. He did not assign any additional permanent impairment or restrictions as a result of the work injury. I obtained an opinion from the client’s treating physician relating to an aggravation of his pre-existing back condition. There was a significant rate dispute and ongoing treatment for PTSD. If the defendant's rate is used, this settlement was equivalent to approximately 80 percent body as a whole impairment, 2018.
- $125,000: This is a workers’ compensation case. The client was helping a nursing home resident stand from a wheelchair when the wheelchair slid backward. The client grabbed the resident to keep him from falling to the floor, at which point she felt a pop in her lower back with tingling in her right leg. Defendants denied causation based on a back surgery ONE year prior to the date of injury. The authorized treating physician did not assign permanent impairment or work restrictions. There were no objective findings on imaging, 2017.
- $75,000 for client after tripping & falling in store our client was in a department store when she tripped and fell over a cord. The cord was from a fan that was plugged in behind a counter. She suffered a broken femur head that required total hip replacement surgery. Attorney Jenna Green helped the client receive a settlement of $75,000 in 2022.
