Verdicts / Settlements (Case Results)
- $1,640,312.32 Arbitration Award and $1,200,000.00 bad faith damage settlement, plus factual finding of bad faith against Insurer. Kronlage Family Limited Partnership v. Independent Specialty Insurance Company - In Re Arbitration. Hurricane Ida damage to a commercial property roof in Baton Rouge. The federal court compelled our client into mandatory arbitration before three insurance professionals (not just ordinary arbitrators, but those requiring experience working in a senior capacity for insurance companies for their careers), in Nashville, Tennessee, where the insurer's offices were located. The arbitration panel issued a full award of damages to repair the large, commercial flat roof, plus litigation costs, expert costs and judicial interest. In the order, the panel criticized the insurer for hiding relevant information and untimely adjusting this claim. ISIC had refused to pay anything to our clients until so ordered by this panel, despite ISIC's own initial adjuster who inspected the property in November of 2021 determining that the roof was damaged beyond repair due to Hurricane Ida, and that said roof replacement damages would excess $1,000,000.00. ISIC used the arbitration process and arbitration rules to attempt to hide this information and hide these helpful witnesses/ adjusters involved from Plaintiff. The arbitration panel withheld ruling on the bad faith damages due to the terms of the arbitration provision. Our office secured a $1,200,000.00 bad faith claim settlement with ISIC within a four weeks of the arbitration panel's final award., 2024
