Scholarly Lectures/Writings:
  • Bankruptcy court can be a confusing, even disorienting, place for the uninitiated, especially when rights to real property are involved. One situation that arises from time to time concerns the rights of a tenant when the landlord files for bankruptcy and the building is put up for sale. Two different provisions of the Bankruptcy Code come into play in this scenario:, U.S. Fifth Circuit Issues Important Decision Concerning Rights of a Tenant When the Landlord is in Bankruptcy, Real Estate, Bankruptcy, Landlord/Tenant, 2022
  • Governor John Bel Edwards has signed three measures passed during the recently ended sessions of the Louisiana Legislature that shield businesses, individuals, and government bodies from civil liability for COVID-19 exposure. In combination, these new acts will make it extremely difficult for anyone to recover damages for exposure to COVID-19, even if that exposure results in death or serious injury., Louisiana Legislature Passes Three Laws As Shield Against COVID-19 Liability Arising From Business Operations, Steeg Law website, Convention, Hospitality, Restaurant, 2020
  • Title insurance is ubiquitous in the American real estate market. Lenders generally require mortgagee’s title insurance as a condition before closing on a loan secured by immovable property. Many owners, including most commercial real estate investors and developers, purchase owner’s title insurance to protect their investments. Title insurance in Louisiana, as in most states, is typically issued using forms drafted by the American Land Title Association (ALTA). While in our experience, most title policy holders have a reasonably good sense of the types of title matters that are covered under a standard ALTA policy, they often understand far less about the measure of compensable loss to which they are entitled in the event of a title defect that cannot be cured.  , The Measure of Compensable Loss Under a Standard Title Insurance Policy, 2017
  • Louisiana has strict requirements governing the form of certain types of legal documents, such as donations and wills. Failure to comply with those formalities, while they may seem meaningless to non-lawyers, in fact can lead to serious problems. A recent decision by the Louisiana First Circuit Court of Appeal illustrates the point., Execution of Legal Documents in Louisiana—Formalities Matter, 2014
