- Catastrophic workplace injuries and deaths create a myriad of legal issues that must be identified and evaluated quickly to protect the rights and interests of workers and their families. This presentation helped attorneys understand the different legal issues that must be quickly identified in areas including probate, personal injury, and workers’ compensation. We discussed workers’ compensation immunity and strategies for building a third-party liability claim. We outlined critical and time sensitive actions that attorneys must take to preserve evidence, undertake an investigation, and engage expert witnesses when evaluating a third-party liability claim. We discussed challenges to advance these cases in litigation and strategies to overcome them by highlighting recent case examples. , Co-presenter, Catastrophic Workplace Injury Claims: The Intersection of Personal Injury and Workers’ Compensation, Maine State Bar Association, Attorneys, 2025
- It’s a relatively common occurrence: an attorney is asked to represent more than one client in the same matter. In a lot of situations, doing so may be mutually beneficial for the clients. But more is not always merrier when it comes to the number of clients, and lawyers can end up in hot water if they don’t consider conflicts that might arise down the road. This presentation educated attorneys on the ethical rules that apply to multiple representation (also known as “common representation” or “joint representation”). We shared best practices for identifying situations where conflicts may arise, advising clients on the risks and benefits of mutual representation, and ensuring that informed consent is obtained from all clients to be represented. , Co-presenter, The More the Merrier?
