Verdicts / Settlements (Case Results)

  • Represented out-of-state defendant in a month long trial resulting from an acquisition of a business gone bad. The issues ranged from performance and parol evidence to causation and conspiracy. There were numerous exhibits, multiple defendants, and complicated issues of law and facts. This was a bench trial in Suffolk Superior Court, and outcome was in favor my client with a $0 defense verdict., 2025
  • With trial approaching and claims for breach of contract and wage act hanging over my clients head, we used the opposing party's failure to satisfy discovery demands and motion in limine, to exclude a tremendous amount of evidence. Client was able to resolve the case without a trial on favorable terms., 2024
  • My client got caught up in a multimillion dollar litigation. The internet picked it up. He lost his reputation and his consulting business. Although the case is still on going in the Superior Court, and he'll be vindicated, without work he had no income. His only asset for survival was his savings and home, which he needed to sell to liquidate and access cash. The opposing party had placed a lis pendens on my client's home so that its sale would be impossible, at least not without escrowing his money for the opposing party.  This of course would have placed immense pressure on him to settle the case at unjust lost.  The opposing party also wanted the home as part of securing what then believe will be a judgment in their favor. Due go multiple suits having been filed by the other side, they filed for the lis pendens in federal court.  Instead of the natural reactions most lawyer take, which is to file an opposition or dismissal, we let it sit for several years giving the other side a false sense of security. Time passed. When the client had exhausted all his savings and was ready to sell his home, we attacked the lis pendens. I entered my appearance in the federal action which had nothing going on except the lis pendens that sat for years. I got it dismissed on the basis court's lack of subject matter jurisdiction. My client simultaneously was able to arrange a buyer. The opposing party rushed to the Superior Court in an attempt to secure a proper lis pendens. However, with that false sense of security allowing lot of time to pass, the Superior Court denied the lis pendens relief and unduly delayed. Client sold the home and accessed his  capital., 2014
  • Highly contested business dispute among members of limited liability company.  The client was in a very tough place. The opposing party had mounted a strong narrative against my client. The client had previous counsel who had compromised the case in several ways. The client was facing contempt of court, and was ordered to provide a highly costly accounting of the company.  I took over the case. Began to breakdown the opposing parties' narrative. Since discovery was closed by the time of my appearance, we strategically did not engage in dialogue about the specific facts that provided the strengths of our case. We spoke in broad generalities in an effort to resolve. We let the other side talk and explain their narrative in an attempt to force my client to take a meager settlement so they can have the business. As they talked over the course of two years, we listened carefully and jotted everything done and by the time of trial knew their entire strategy. They had made many lousy offers so they can take the business. But we stayed focused. Finally trial came. Without any discovery having been conducted, and solely based on the records we could gather, my client prevailed at trial in Superior Court for claims of breach of fiduciary duty. Judgment, plus interest, exceeded more than $200,000., 2024
