Kelsey Rose is a dedicated attorney with the law firm of Morgan & Morgan’s Boston, Massachusetts, location. Ms. Rose worked as a legal intern to the Honorable Judge Judith Fabricant at the Massachusetts Superior Court. She earned her Juris Doctor in 2014 and passed both the Massachusetts and New York Bar in the summer of 2014. Additionally, she has appeared before the United States Court of Appeals for the 1st Circuit and the federal courts of Massachusetts. She is an active member of the Massachusetts Bar Association.

- $8.7 million for injured homeowners. The Plaintiffs were represented by Donald R. Grady and Kelsey R. Raycroft of Sheff Law Offices, P.C in Boston. A Middlesex Superior Court jury found in favor of local a homeowners, awarding more than eight million dollars to a family who suffered permanent injuries due to the negligence of their oil heat service company. In December of 2009, the Plaintiffs ran out of home heating oil. After having their oil tank filled and the heat restored, the furnace began to puff smoke into their partially finished basement. The family called The Service Department (TSD) a home heat service and repair company, to have their system serviced. During the servicing of their system, a flange fitting was left loose, allowing oil to slowly leak onto the unfinished side of the basement. The leak was eventually discovered by the Plaintiffs who again called TSD to remedy the spill but their attempt included the use of hazardous chemicals which further exacerbated the situation. Eventually, the Fire Department, local Board of Health, and the Massachusetts Department of Environmental Protection was called to assess the leak, but the damage had been done to both the property and to the Plaintiff. Over the next few months, the Plaintiff’s health deteriorated to the point where he could no longer work and was oxygen dependent. Prior to this incident the Plaintiff had been in the military and had become very successful creating his own business and securing numerous contracts with the department of defense. At the time of trial, the Plaintiff’s condition has stabilized but as his doctor testified, he will be unable to work and will be dependent on oxygen for the duration of his life. The jury found the primary defendant, TSD, the oil heat service company, liable for injuries sustained by the plaintiffs. At the close of evidence, attorneys for the Plaintiffs were successful in their motion for directed verdict against the main defendant’s counter-claim of misrepresentation. At trial, there was no dispute that the oil leak had occurred; however, there was much dispute over how the leak had occurred and the amount of oil that had leaked. TSD testified the leak had occurred but offered that the leak could not have occurred due to installation of an Oil Safety Valve (OSV). The jury heard expert testimony from heat system engineer for the Plaintiffs as to how the system worked, how the leak occurred despite installation of an OSV as well as the defendant’s duties as oil heat technicians. The trial lasted seven (7) days at Middlesex Superior Court in Woburn before the Honorable Judge Robert Gordon. The $6.2 million verdict against the single defendant consisted of $7.2 million in damages for the damages stemming from the physical injuries suffered by the Plaintiff with 75% attributed to defendant and 25% attributed to the Plaintiff for contributory negligence ($5.4 million), $800,000 for the loss of consortium claim made by the wife of the physically injured Plaintiff, and $30,000 for property damage.
