Michael L. Chinitz is the founder of Chinitz Law LLC, where he focuses his practice on employment counseling and litigation, representing both employers and employees. Of special focus is Michael’s executive mobility practice. In this practice, Mike represents upper-level management and C-Suite executives (both public and private company executives in a full range of services relating to an executives transition from one position to another. Services include the drafting and negotiation of employment agreements; non-disclosure agreements and restrictive covenant agreements (noncompetes; nonsolicitation agreements) as well as restricted stock, stock option, phantom share and other equity arrangements). Mike has substantial public company experience and is accustomed to working on tight timetables and meeting securities filing obligations. Mike also advises corporations on compliance with state and federal employment laws; counsels employers on hiring, firing, discipline, accommodating disabilities, and responding to allegations of discrimination and sexual harassment.
Mike represents employees to try to enhance severance packages offered to them. Mike also provides important counseling regarding restrictive covenant agreements, an employee’s trade secret obligations, and many other issues to try to effect a smooth transition from one position to another. Mike has considerable experience litigating wrongful termination cases of a broad scope, and has prosecuted and defended noncompete, non-solicitation and trade secret cases before the Massachusetts state and Federal courts, the AAA, and before the Financial Institution National Regulatory Authority (“FINRA”).
Mike also represents investment advisers and securities firms in proceedings in court and before the FINRA. Many of these matters have involved noncompete and nonsolicitation claims. His other civil litigation experience has encompassed shareholder and partner disputes, claims for breach of fiduciary duties, unfair trade practices, and professional negligence. His successful track record in all these endeavors has earned Mr. Chinitz a great deal of recognition from his colleagues, including an AV Preeminent* peer-review rating through Martindale-Hubbell and an "Excellent" peer-review rating through Avvo. Mike attended Boston University School of Law, where he was an editor on the Boston University Law Review before being awarded his Juris Doctor, summa cum laude in 1988.
