Judith M. Flynn is an elder law attorney in Quincy, Massachusetts, at the firm of Falco & Associates, PC. She has dedicated her entire career to helping the elderly and disabled, and their caregivers, deal with complex legal issues.  She has earned the designation as a Certified Elder Law Attorney (CELA) by the National Elder Law Foundation, the only national organization accredited by the ABA  to offer certification to  attorneys in the specialization of  elder law.  (The Massachusetts  Supreme Judicial Court does not recognize legal specialties for certification.)

With an exclusive focus on elder law, estate planning and disability planning, Judy works closely with clients to develop holistic and comprehensive plans that can be revised over time as situations change.  She handles all aspects of elder law, with a particular focus on helping clients to obtain in-home care benefits and nursing home coverage, while maximizing spousal and other protections. With a career spanning over two decades, she has assisted people with all aspects of long-term care planning, estate planning, crisis planning, guardianships and conservatorships, trust and probate administration, and fiduciary litigation. 

Attorney Flynn graduated from the University of Massachusetts - Boston in 1994, summa cum laude, and was the recipient of the T. Scott Miyakawa Memorial Prize in sociology. She then attended Suffolk University Law School to obtain her Juris Doctor, cum laude, in 2001. She holds memberships in organizations such as the Massachusetts Bar Association and the National Academy of Elder Law Attorneys (NAELA). She is currently on the Executive Committee of NAELA, serving as Vice President.  After serving on the Board of the Massachusetts Chapter of the National Academy of Elder Law Attorneys (MassNAELA) for several years, Judy served as President in 2014. Judy also served as President of the Massachusetts Guardianship Association for two years, in 2010 and 2011.

In addition to being considered one of the region’s top elder law attorneys, Judy has been honored with numerous awards and honors, including Massachusetts Lawyers Weekly’s Top Women of Law and Boston Magazine’s Five Star Wealth Manager (Estate Planning) award.  Judy recently received the 2022 Deborah H. Thomson Advocacy Award from the Massachusetts Chapter of NAELA (MassNAELA).  She received the National Guardianship Association’s Outstanding Affiliate Member Award and multiple President's Awards from MassNAELA. In addition to publishing articles in various journals, she has also lectured at conferences and events on a variety of elder law issues.

  • Appeal No:  1718268 JS vs. MassHealth - at issue was whether the Entrance Deposit paid upon admission to the Continuinig Care Retirement Community (CCRC), Linden Ponds, was a countable asset for MassHealth eligibility purposes in a case where one member of the couple resided in the CCRC's nursing home and the other resided in her independent apartment at the CCRC.  According to the decision: "the appellants have carried their burden of showing, by a preponderence of the evidence, that the deposit fee they paid to the CCRC is not an available resource in a MassHealth eligibility determination." Community Spouse protections apply in CCRCs just as they do in any other setting under the MassHealth regulations. , 2018
