Elder Law Attorney Judith M. Flynn has devoted her entire career to helping elders and people with special needs and their families find the peace of mind they deserve for their important and complex legal issues.

Focusing exclusively on elder law, estate planning and special needs planning, Attorney Flynn delivers the personalized attention and compassionate support her clients need when developing a comprehensive plan regarding long-term care, estate planning, crisis planning, special needs planning, guardianships and conservatorships, and all other related matters. She also represents trustees, beneficiaries and personal representatives by assisting them with all aspects of probate and trust administration.

A 1994 summa cum laude graduate of the University of Massachusetts at Boston, Attorney Flynn attended Suffolk University Law School, where she obtained her Juris Doctor, cum laude, in 2001. She served as an Associate at the Law Office of William J. Brisk from 2002 until 2004, when she established her own private practice on the South Shore.

A consummate professional and dedicated advocate for the rights of seniors, Attorney Flynn is currently serving on the Board of Directors of the National Academy of Elder Law Attorneys (NAELA), and serves as Co-Chair of the State Advocates Committee.  She served as President of its Massachusetts Chapter (MassNAELA) in 2014, and is an active member of the Chapter's Public Policy and Litigation efforts, advocating for the rights of seniors across the Commonwealth. She is also a member of the Massachusetts Bar Association, and serves on its Elder Law Advisory Task Force to review and revise the annual MBA/MassNAELA Elder Law Education Program workbook.  Flynn also served as President of the Massachusetts Guardianship Association in 2010 and 2011.

Regarded as one of the top elder law attorneys in the region, Attorney Flynn has received numerous awards and honors throughout her career. Massachusetts Lawyers Weekly named her a "Top Woman of Law" in 2011, and she has been listed several years in Boston magazine as a Five Star Estate Planning Attorney.

She and her husband, Bill, have three adult children.  Bill and Judy were the first married couple inducted into the South Boston Sports Hall of Fame in the same year, Bill for hockey and Judy for track and field/running.

  • Appeal No:  1718268 JS vs. MassHealth - at issue was whether the Entrance Deposit paid upon admission to the Continuinig Care Retirement Community (CCRC), Linden Ponds, was a countable asset for MassHealth eligibility purposes in a case where one member of the couple resided in the CCRC's nursing home and the other resided in her independent apartment at the CCRC.  According to the decision: "the appellants have carried their burden of showing, by a preponderence of the evidence, that the deposit fee they paid to the CCRC is not an available resource in a MassHealth eligibility determination." Community Spouse protections apply in CCRCs just as they do in any other setting under the MassHealth regulations. , 2018
