The Michigan State police investigated the accident and determined that the plaintiff was at fault and that defendant had the right of way. A witness stated that the defendant was not speeding. The plaintiff retained an accident reconstructionist who obtained the black box data from both vehicles and determined that the defendant driver was speeding and traveling in excess of the posted speed limit.
