  • I served as a keynote speaker at the ASTPS Tax Super Conference in Rockwall, Texas, where I presented a seminar on the criminal tax implications of willfulness. The session focused on how willfulness operates as the central mens rea element in federal tax crimes, defined by the Supreme Court in Cheek v. United States as the voluntary, intentional violation of a known legal duty. I explained the distinction between civil negligence and criminal conduct, emphasizing that the government must prove knowledge of the duty and a deliberate decision to violate it. The presentation examined how prosecutors establish willfulness through circumstantial evidence, including patterns of noncompliance, prior IRS notices, false statements, concealment of income, and taxpayer sophistication. We also discussed reliance-on-advisor defenses, the risks of obstruction charges, and practical red flags indicating a case may shift from civil examination to criminal investigation.
