    • Minnesota Supreme Court in Cedar Bluff Townhome Condominium Association, Inc. v. American Family Mutual Insurance Company, 857 N.W.2d 290, (Minn. 2014) a landmark insurance coverage case concerning an insurance policyholder's right to have their property repaired with matching building products. The takeaway from Cedar Bluff is that insurance companies are obligated to provide their policyholders, including condominium and townhome associations, with "comparable" replacement products, including a reasonable color match. This has broad insurance coverage implications for property damage claims in Minnesota. It strengthens the rights of property insurance holders, who now do not have to settle for repairs with mismatched materials from their property insurance companies, 2014
    • Minnesota Supreme Court in the matter of Poehler v. Cincinnati Insurance Company, July 19, 2017, __N.W.2d __, 2017 WL 3045531. This case involved whether a policyholder could recover interest on an insurance appraisal award when an insurance company undervalues a claim. This is a monumental decision for Minnesota policyholders. Now, when an insurance company undervalues a claim, the policyholder will be entitled to recover interest on an appraisal award. This will incentivize insurers to make fair claim valuations from the outset, because if they do not, then the insured will be able to recover the value of the claim plus interest. Not only is this a fair result, but it will help offset the costs of pursuing the insurance company when it undervalues a claim, 2017
