• When David suffered a permanent foot injury in a crash caused by an uninsured driver, his own insurance company refused to pay the full value of his uninsured motorist benefits. Lyndsey sued the insurance company and got an order from the judge to take the deposition of the insurance adjuster to show that David’s insurance company was acting in bad faith to deny is claim. Lyndsey held a deposition, which resulted in David’s company paying out all of his $250,000 in insurance.
• Lyndsey's client was crossing the street with friends to grab a snack in between games at their middle school basketball tournament when he was hit by a motorcycle, breaking his leg. The insurance company for the motorcyclist blamed her client for jaywalking, and refused to pay for his losses. His mother retained Lyndsey, who got security footage from the exterior cameras of a nearby business. While the cameras did not show the incident, it showed the motorcyclist driving at a speed that was obviously too fast for the location and that the sidewalk where the insurer said he and his friends should have been walking was actually under construction. With the footage, the insurance company reversed their position and paid out all of the coverage available.
• Lyndsey's client was riding his bike home when he was struck by a driver who fled the scene and left him laying in the roadway. After multiple vehicles stopped to help, he was hit again by another inattentive driver. He had a significant injuries and hundreds of thousand dollars in medical expenses. While police were not able to locate the hit and run driver, Lyndsey was able to obtain all of the insurance coverage available from the second driver to hit her client. Given the limited amount of auto insurance to pay for his losses, Lyndsey was able to negotiate a full waiver of his medical expenses.
• Lyndsey's client was in two car crashes that were one year apart. Neither of the crashes were her fault, and she suffered injuries in both crashes, some of which were very similar. The insurance companies for both bad drivers blamed the other crash as being the cause of her injuries. The insurer for the truck that caused the second crash completely denied payment for her injuries. Lyndsey dug into the complicated medical case and went to her doctors to get support for how each of the crashes had contributed to her life-changing injuries. After presenting this evidence to the insurers, Lyndsey obtained a combined settlement of $1.35 million for her client.
• Lyndsey's client was killed in a car accident, and nearly a year later, his family received a reconstruction report from law enforcement that stated Joe was the cause of the accident. However, the report also contained an eyewitness account stating that the other driver – not our client – had caused the accident. Lyndsey agreed with the family that report seemed inconsistent. Lyndsey retained and independent reconstructionist to review all of the evidence collected by law enforcement. The independent reconstruction confirmed our client was not the cause of the crash. Lyndsey sued the at-fault driver and obtained a $1 million judgment for the family.
