Attorney Profile

A partner at Fuller, Seaver, Swanson & Kelsch, P.A., Mr. Kelsch represents clients in the areas of construction law, bankruptcy and creditor/debtor rights, and real estate law.

In his construction law practice, Mr. Kelsch represents both owners and contractors in payment and performance disputes, including the efficient filing and resolution of mechanic’s liens. He also works with clients in drafting and reviewing contracts to minimize the risk of litigation.

Bankruptcy is a complicated area of law, and Mr. Kelsch has extensive experience in handling all facets of bankruptcy-related issues, including: filing bankruptcy petitions on behalf of corporate and individual debtors; defending and prosecuting exemption/discharge objections and fraudulent transfer/preference claims, and; preparing and filing proofs of claim. He has represented corporate and individual debtors, creditors, unsecured creditors’ committees, and bankruptcy trustees in Chapters 7, 11, and 13. In the debtor/creditor rights arena, Mr. Kelsch has effectively represented clients in judgment enforcement, asset protection, taxation offers in compromise, and debt negotiation.

In his real estate practice, Mr. Kelsch works with clients in resolving disputes related to contracts for deed, association liens/violations, purchase agreement non-disclosures, boundary lines, and landlord/tenant. He also negotiates short sales, deeds in lieu of foreclosure, and foreclosures.

Mr. Kelsch's fees are fairly structured to fit the specific needs of his clients. Dialogue with potential clients typically begins with a brief telephone consultation to get an adequate handle on the legal issue and whether it is a matter that he can adeptly handle. He does not charge a fee for this initial consult. If Mr. Kelsch determines that an in-person meeting is necessary, coupled with review of pertinent documents, he does charge a modest consult fee, which if appropriate, is credited againt future legal billings should the decision be made to retain him. Mr. Kelsch does not provide legal advice without first entering into a formal attorney/client relationship and the remittance of the required retainer fee.

A graduate of the University of Oklahoma, Mr. Kelsch obtained a Bachelor of Arts degree in 1995, where he graduated cum laude. In 1999, he graduated with distinction from the University of North Dakota School of Law. Mr. Kelsch is admitted to practice in Minnesota, the U.S. District Court for Minnesota, and the Court of Appeals for the 8th Circuit. He is a member of the Hennepin County Bar Association and the Minnesota Bar Association.
