    Todd S. Werner is an attorney at Carlson Caspers who practices intellectual property litigation and counseling. Mr. Werner has nearly two decades of experience representing large and small companies confronting IP issues in a wide array of technlogies including the chemical, biotechnological, electrical, and mechanical arts. Leveraging his degree in biochemistry, Todd has extensive experience representing generic pharmaceutical companies challenging the patent rights of their competitors through ANDA litigation, as well as nutraceutical companies involved in patent disputes. With a focus on litigation in federal courts, Mr. Werner's experience also includes claims involving unfair competition, trademark disputes, and general commercial litigation.

    Over the course of his career, he has successfully litigated and settled many complex and substantial patent disputes. Among his victories, Todd has defeated a series of patents to pave the way for his client to market a product with annual sales well exceeding $1 billion. He also helped a client defeat a Schlumberger subsidiary's claims of patent infringement against a small, family-owned business in Minnesota. After defeating 114 of 117 claims through a series of inter partes challenges at the United States Patent and Trademark Office, Mr. Werner worked to secure an award of over a $1 million in attorneys fees in federal court.     

    In addition to his private practice, Mr. Werner is heavily involved in the legal community through volunteer work. He participates in the Veteran’s Consortium Pro Bono Program. He has also handled labor and employment cases on behalf of workers through the Federal Bar Association’s Minnesota Chapter Pro Se Project, and previously taught intellectual property moot court at the University of Minnesota Law School. He also founded and serves as the President of Hopeful Halos Foundation, a non-profit organization that raises funds to help support research for a cure for Angelman Syndrome, a very rare genetic disorder that profoundly impairs cognitive development.   

    Mr. Werner graduated summa cum laude from Michigan Technological University with a bachelor’s degree in biochemistry. He went on to earn his law degree from the University of Minnesota Law School, graduating cum laude. He is qualified to appear before all Minnesota state courts, the U.S. District Court for the District of Minnesota and the U.S. Court of Appeals for the Federal Circuit.
