Verdicts / Settlements (Case Results)
- Jury Trial - Not Guilty - Domestic Assault. My client and I went to jury trial after my client was charged with domestic assault. The jury found my client Not Guilty of all counts after a three-day trial. I believed my client's version of event, the state believed the alleged victim, the jury believed the truth. , 2025
- Stay of Adjudication - Presenting Prohibited Item at Airport Screening Area. It is extremely rare to avoid a conviction when presenting a firearm at an airport. However, Mr. Lushanko secured several support letters and demonstrated that a conviction would jeopardize his client's career. As a result, the State agreed to keep the offense off his record., 2023
- Case Dismissed - Receiving Stolen Property / Aiding and Abetting Firearm Possession. I submitted a compelling brief to dismiss the charges, arguing a lack of probable cause and absence of criminal intent. After reviewing the brief, the State dismissed the charges without a response brief., 2023
- Reduced Charges - 4th Degree DWI to Petty Misdemeanor Failure to Drive in a Single Lane. I successfully negotiated with the prosecutor to reduce a DWI charge to a petty misdemeanor. This outcome was achieved due to a low test result and the absence of evidence showing drugs in his client's system., 2023
- Reduced Charges - 4th Degree DWI to Public Nuisance. My client was charged with a DWI after a blood test revealed marijuana in his system at the time of driving. I argued that the amount of THC in his system was not likely to cause impairment, and the prosecutor found my reasoning to be credible. , 2023
- Reduced Charges - 2nd Degree DWI to Careless Driving. My client was facing a DWI involving two aggravating factors, which made it a 2nd Degree DWI. I motioned to suppress and dismiss the case due to a lack of probable cause for my client's arrest. The day of the contested hearing, the prosecutor offered to dismiss the DWI in exchange for a plea to careless driving, which my client happily accepted. , 2025
- Dispositional Departure (No Prison Time) - 1st Degree Aggravated Robbery, 1st Degree Burglary. My client was facing a mandatory minimum of 5 years in prison if he was convicted of 1st Degree Aggravated Robbery due to a firearm being involved in the offense. I was able to resolve the case with a plea to Burglary to avoid the mandatory minimum. At sentencing, the State was asking for 4.5 years in prison and we were seeking probation. After written and verbal arguments, the judge sided with us and did not sentence my client to prison time. , 2025
- Case Dismissed - Violation of Order for Protection. My client was at an event and the protected party was there as well. There was no evidence that my client made contact with the protected party at this event, and the order for protection did not include language regarding the two parties being at a gathering or event at the same time. Before making written arguments on probable cause, I explained my reasoning to the prosecutor and he dismissed the case. , 2025
- Case Dismissed - Reckless Discharge of a Firearm within a Municipality. My client shot a rodent in his backyard in a residential neighborhood. Although it was evident that my client discharged a firearm, there was no evidence that the discharge was reckless. I filed a motion and wrote a brief to dismiss the case for lack of probable cause. After reading my arguments, the State dismissed the case without writing a response brief. , 2024
- Jury Trial - Not Guilty - Domestic Assault. My client asserted his innocence since the date he was charged and he had a story that made sense and lined up with the evidence. I was also able to point out inconsistencies in the State's case. The jury ultimately sided with us. , 2023
- Jury Trial - Not Guilty - Domestic Abuse No Contact Order Violation. The protected party claimed that my client FaceTimed her from another person's phone. I was able to establish doubt, because there was no solid proof of contact. The jury deliberated for only 7 minutes before returning with a not guilty verdict. , 2023
