Minnesota Court of Appeals held that the district court did not err in the appointment of a guardian and conservator when it found Powers was an incapacitated person and his needs could not be addressed by less restrictive means., 2024
- Estate of Tomczik, 992 N.W.2d 691 (Minn. 2023). Minnesota Supreme Court held in favor of personal representative, who was a brother of the testator, that the clause in the will devising half of estate to "my wife's heirs-at-law" did not allow parents of testator's former wife to inherit half of his estate because the clause referred only to members of a group defined by family ties, and, due to divorce, testator did not have a "wife" at the time of his death and the class of his "wife's heirs-at-law" no longer existed at the time of death., 2023

- Estate of Mealey, 695 N.W.2d 143 (Minn. Ct. App. 2005). Minnesota Court of Appeals held in favor of personal representative that testator's father did not have standing to object to the personal representative's final account or appeal the District Court order allowing the final account because he had no legal or other right affected by the accounting of the testator's estate and he could not gain standing by trying to assert a right that the attorney general's office chose not to assert after being fully apprised of father's objections., 2005
- In re Conservatorship of Brady, 607 N.W.2d 781 (Minn. 2000). Minnesota Supreme Court held that the district court is not required to consider Brady's expressed preference to live in Pennsylvania with her daughter when such preference was not expressed when Brady was competent prior to the appointment of her conservator, and therefore the district court did not abuse its discretion in determining that it was in Brady's best interest that Minnesota is her place of abode. , 2000
