Attorney Profile

Austin has a nationwide practice focused on complex litigation including data breach and privacy litigation, consumer class actions, and sexual assault liability. Austin has played lead roles representing consumers in several of the largest data breach multi-district litigations (MDLs) in U.S. history, including In re: Equifax, Inc. Customer Data Security Breach Litigation (N.D. Ga.) (case currently pending), In re: Anthem Data Breach Litigation (N.D. Ca.) (settlement benefits of $115 million), In re: The Home Depot, Inc. Customer Data Security Breach Litigation (N.D. Ga.) (settlement benefits of $29 million), and In re: Target Consumer Data Security Breach Litigation (D. Minn.) (settlement benefits of $23.2 million). In addition to multi-district litigation, Austin was recently appointed as settlement class counsel in the Academy of Art University Data Breach Litigation (Cal. Sup. Ct., San Fran. Cnty.) (settlement approved in July 2018) and as interim class counsel in the National Board of Examiners in Optometry Data Breach Litigation (D. Md.) ($3.25 million settlement pending final court approval).

Austin also represents small businesses involved in business disputes, personal injury victims in catastrophic injury and wrongful death cases, and victims of sexual assault in civil cases against their perpetrators and other negligent parties. He recently represented a woman in a lawsuit against Uber Technologies, Inc. after the woman was sexually assaulted by her Uber driver. Through investigating the matter, Austin determined that the driver was previously convicted of attempted first-degree murder and that Uber had received multiple warnings that the driver assaulted and harassed other women. The resulting lawsuit asserted claims for negligence, fraudulent misrepresentations, and intentional infliction of emotional distress, among other claims.
