Verdicts/Settlements:
  • Appellate Decision - The Missouri Court of Appeals, Eastern District reversed and remanded the trial court's judgment that the client withdrew as a member of the limited liability company of which he was a member. The trial court determined that the client breached the operating agreement in various respects and, thus, effectively withdrew as a member. While the Eastern District affirmed the breach of the operating agreement in one respect, it reversed the trial court's finding regarding the other alleged breaches. Additionally, the Eastern District held that the actions of the Client did not constitute a withdrawal from the LLC pursuant to either the operating agreement or Missouri law., 2018
