Attorney Josh Tomsheck is a partner at Hofland & Tomsheck in Las Vegas, where he leads the Criminal Trial Practice Group. A seasoned trial lawyer, Josh has dedicated his career to advocating for the rights of those being investigated or charged with crimes. With years of experience as a chief prosecutor and now as a criminal defense attorney, Josh has built a reputation as one of the best trial attorneys in Nevada.
Before co-founding Hofland & Tomsheck with Bradley J. Hofland, Josh spent years working as a Chief Deputy District Attorney in the Clark County District Attorney’s Office. His skills and dedication led to a rapid promotion, placing him in the Major Violators Unit’s Gun Crimes Section. There, he specialized in prosecuting violent felonies and firearm-related offenses. After years of trial work as a prosecutor, Josh transitioned to private practice to focus on defending individuals in their time of biggest need.
Josh’s legal practice is focused on litigation and trial work. He has served as lead attorney in 100’s of trials in Nevada Municipal, State and Federal Courts, having earned not guilty verdicts in homicide, sex assault, conspiracy, kidnapping, battery, theft, white collar and property crimes. Additionally, he has successfully defended clients charged with DUI and domestic violence, achieving an impressive success rate of over 95% in the more than 200 jury and bench trials he has taken to verdict. His courtroom skills have been demonstrated before the Nevada Supreme Court, where he has argued on numerous occasions, resulting in numerous published decisions.
Specializing in complex criminal litigation in both state and federal courts, Josh has served as lead counsel on thousands of cases, including hundreds of homicide cases. He is one of only a few attorneys in Southern Nevada certified under Nevada Supreme Court Rule 250 to be appointed as lead counsel in capital murder cases. Josh’s expertise in federal cases has also earned him selection to the Criminal Justice Act (CJA) panel by the U.S. District Court for the District of Nevada, allowing him to represent individuals charged with complex federal crimes.
Josh is often retained before the filing of criminal charges, at the investigation stage, where he has successfully intervened and prevented his clients from facing prosecution altogether. His ability to negotiate with prosecutors and investigators has resulted in many clients avoiding criminal charges in severe cases, including murder and sexual assault allegations.
Josh has been involved in several high-profile cases that have garnered both local and national media attention. His work has been featured in television programs such as “Dateline,” “48 Hours Mystery,” and “Snapped.” His trials have also been covered by networks like CourtTV, Law & Crime, Investigation Discovery, and InSession, earning him national recognition. In addition to his legal practice, Josh is often asked to provide expert commentary on complex legal issues, making appearances on local and national news outlets.
Josh is one of only two attorneys in Nevada certified by both the National Board of Trial Advocacy as a Criminal Trial Specialist and registered with the State Bar of Nevada as a Certified Specialist in Criminal Trial Advocacy. He is also a member of the National College for DUI Defense, and his skillful representation of both injured and accused clients has earned him multiple honors, including being named a “Super Lawyer” and a “Top 100 Trial Lawyer” in Nevada by various publications. Josh is a Life Member of the National Association of Criminal Defense Lawyers.
Josh is committed to staying at the top of his field, and he regularly teaches and lectures on trial strategies, providing training to law students and fellow attorneys as an instructor for the State Bar of Nevada Trial College.
