            Donald M. McHugh is a senior partner of the law firm of McHugh & Macri in East Hanover, New Jersey, formed in 1978. He is a certified elder law attorney (CELA) by the National Elder Law Foundation. Former president of the New Jersey chapter of the NAELA (National Academy of Elder Law Attorneys): 2005 chair of the Elder/Disability Law Section of the New Jersey State Bar Association; chair of the New Jersey Medicaid regulation committee. Super Lawyer in elder law 2008-2013; recipient of the New Jersey Bar Association first “Distinguished Service” award in elder/disability law. Elected to the Council of Advanced Practitioners (CAP) 2012.

           He is a frequent author and lecturer on elder law/ disability law to civic groups and professional legal societies, including the New Jersey Institute of Continuing Legal Education of the New Jersey Bar Association. His practice addresses all aspects of elder and disability law, tax, estate and asset preservation planning to provide for the supplemental needs of disabled and elder clients. He also specializes in probate and Medicaid litigation issues.

           Don has handled Medicaid denial litigation from Fair Hearing through the Dederal 3rd Circuit Court of Appeals, including the landmark New Jersey ruling In Re Labis that authorized guardians to conduct Medicaid planning.

Published Cases

Don McHugh has experienced in Medicaid litigation from Fair Hearing through Appellate Division appeals, including the Johnson s. Guhl case at the Federal level; achieved a landmark New Jersey ruling in re Labis (1998) to permit guardians to conduct Medicaid planning; assisted fellow counsel to expand the Labis authority to non-spousal cases in In re Keri (2003) and overturned State payback requirement of commercial annuities in AB v. DMAHS (2005)

Distinguished Service Award

In July, 2008, Don McHugh received the first “Distinguished Service” Award from the 500 member Elder Law Section of the New Jersey State Bar Association. Don considers this his most prestigious achievement in his 38 years of practice. He served as Chair of the Elder Law Section in 2005-2006.

Also, in 2012 Don was nominated and accepted to Council of Advanced Practitioners (CAP) membership  of 72 attorneys nationwide in the forefront of elder law.
