Verdicts/Settlements (Case Results):
  • Client was charged with igniting an incendiary device and throwing it towards police during the Trenton riots. Client was identified on videos through his tattoos. Ms. Lavine was able to negotiate a reasonable offer for client arguing that he had gotten "caught up" in the movement and the incendiary device was no more than a firecracker. No police officers were hurt by this firecracker. Client ultimately took responsibility for his behavior and is serving a jail sentence. However, his jail sentence was substantially reduced via negotiations entered into between Ms. Lavine and the State., 2023
  • Client was charged with attempted murder and possessing a handgun. Suspect was caught on video camera shooting at another individual in broad daylight in a residential neighborhood. However, suspect had a mask on and was identified through other means. The State had indicated that client was suspect based on clothing, cell phone records, and the vehicle in which suspect left. Ms. Lavine was able to convince the prosecutor that the proofs were insufficient and client was allowed to plea to a lesser charge. Client could have been sentenced to ten years (or more)., 2024
  • Client was made aware of a judgment against her for $150,000 when she attempted to purchase a house. It was determined that plaintiff had filed a suit against client for a car accident wherein he was a bicyclist and struck by a hit and run vehicle. Ms. Lavine filed a motion to vacate the judgment. Plaintiff's counsel and counsel for the insurance company objected and filed answers to the motion. A plenary hearing was held with witnesses. Through her cross examination, Ms. Lavine was able to show that the process server had no memory of serving the client. She was further able to show that client was not served and had no knowledge of the lawsuit and subsequent judgment against her. Judge vacated the judgment against client. After court, Ms. Lavine was able to persuade plaintiff's counsel and counsel for the insurance company to dismiss the action against client. A stipulation dismissal was filed with the court., 2024
  • Client was charged with thirty charges ranging from theft, burglary, extortion and harassment. Client is a young adult who happens to be black and gay. He was having sexual relations with an older white gentleman (victim) who was "closeted." Victim was paying client money and buying him things. At some point, victim was not satisfied with the relationship and stopped giving client money and gifts. Client was upset by the cessation of money and went to victim's house which he illegally entered and broke items belonging to victim. Client further threatened to expose victim if he did not continue to fund his lifestyle. Ms. Lavine was able to convince the prosecutor and the court that this was essentially a lover's quarrel and that the broken items had no real value. She was further able to show that client had previously been given a key to the victim's house and that he had been welcomed there many times. Client was able to plead to a nominal charge on the condition he have no contact with the victim. Client was facing ten years in jail., 2024
  • Client was charged with Unlawful Possession of a Weapon. Client was found on the porch of a home with two other individuals when police arrived at the residence. Client was the subject of an investigation of a person selling large quantities of drugs from his house. A search warrant was obtained and as subsequent search of client's house revealed large quantities of drugs and packaging material. Client is a male in his sixties who had not had a criminal charge for many years. His previous convictions, dating back over fifteen years, were for drug related offenses. Ms. Lavine was able to provide information to the prosecutor and court which showed the compelling reasons for client to have slipped back into the drug trade. Client was willing to accept responsibility but wanted to be released from jail after pleading guilty and before sentencing. Courts generally do not allow individuals who are facing significant jail time to be released for fear that the client will not appear back in court. In this case, through Ms. Lavine's diligent work, client has been released from jail., 2024

The police officers felt they had reasonable suspicion to search the vehicle and a K-9 officer was called to the scene. After the K-9 dog positively indicated there was contraband in the car, search of the vehicle led to the discovery of a handgun and drugs. Ms. Lavine reviewed the discovery along with the numerous videos associated with the arrest. She was able to successfully argue that the length of time client had to wait for the K-9 officer to arrive at the scene was too long. As a result, client was able to plead to possessing the drugs and the gun charge was dismissed. Client received a sentence which allowed him to be released from jail. He was subject to five years in jail., 2024
