Attorney Lee S. Goldsmith, M.D. contributes not only his legal experience to each case he represents, but also his experience and training as a medical doctor. Dr. Goldsmith graduated from the New York University School of Medicine in 1964 and from the New York University School of Law in 1967. He is also certified as a civil trial attorney by the Supreme Court of New Jersey. With these impressive credentials, Dr. Goldsmith represents individuals in cases such as medical malpractice, nursing home malpractice, products liability involving pharmaceuticals and medical devices, Medicare and insurance fraud, workplace failures, automobile accidents, federal and military tort claims, and general negligence.

He also prides himself that he is called upon frequently to represent health care professionals before state regulatory authorities and has represented many physicians before the Office of Professional Conduct in New York and the State Board of Medical Examiners in New Jersey.  Dr. Goldsmith is admitted to practice within the states of New York and New Jersey, and is licensed to practice medicine in New York state. Verdicts/Settlements (Case Results):
  • In the midst of this COVID crises we just resolved a matter for a 73 year old grandmother.  She had been in an auto accident and sent to a pain management physician who sent her to an orthopedic surgeon who operated on her cervical spine leaving her hemiplegic, that is partially paralyzed on one side of her body.  She had had many back operations over the years and had not worked for years.  Knowing that she needed the funds and knowing that we would not see a trial for at least a year we resolved her claims for $750,000. , 2020
  • We have tried many cases over the years but probably one of the most rewarding was for a mother of four, who was unmarried but had been with the father throughout the births of their children.  The fact that they were not married affected the damages that could be won and sustained.  The defendant did not wish to settle.  Facts:  The mother, thought 37 had a poor past medical history with high blood pressure and a stroke.  She presented to an urgent center with chest pain and sent home after an ECG and a chest X-ray.  That night she died of a dissecting aneurysm of the aorta.  The economist valued the case at $440,000.  The jury verdict was $860,000.  The money was all going to the children and was to be used for their educations.  , 2019
  • A new born baby was found to have anemia and required a transfusion prior to discharge.  The discharging pediatrician recommended that a close watch be placed on the child hemoglobin levels.  The treating pediatricians failed to do so and the anemia became so severe that the child crashed and suffered permanent brain damage.  A pediatrician and nurse practitioner were primary involved but a second pediatrician saw the child on one occasion.  The matter was resolved for $2.4 million , 2018
  • Fifty six law suits were brought against two New York Neurosurgeons for performing unnecessary and un-indicated surgeries.  The vleints came from 40 different states and ranged in age form 4 to 55 years.  The surgeons, with no medical justification performed spinal surgery severing the filum terminale of each patient.  All matters were resolved prior to trial with total settlements in excess of $30 million.  , 2015
