  • Writing a statute is very complicated. It is also important to leave some room for litigants, attorneys and Judges to have discretion, some “wiggle room” since each case is unique. In 2015, New Jersey enacted the most significant revisions to the law of alimony since 1971. Among other things, retirement, job loss and cohabitation were addressed for the first time in a statute. However, the effective date - the date any modification goes into effect - was not addressed in the revisions to the law.  In simple English, let’s say you retire in May, file with the Court to end alimony in June, and the case is decided by a Judge in December. If the Judge grants your application and ends the alimony, does it date back to the day you retire, the day you filed or the date of the decision by the Court? This issues is called retro-activity, and it is a very hot topic in the law right now.  The article addresses the issue, and argues for a broad concept of retro-activity.   , Co-Author, The Not-So "New" Alimony Statute: Retroactivity Questions Remain Unanswered, New Jersey Law Journal, Volume 228, No. 3 - January 2022, 2022
