Jeffrey M. Eilender joined the Firm in July 1995 and became a partner in 1999. Mr. Eilender received his A.B. from Cornell University in 1988 (magna cum laude in History), where he was elected to Phi Beta Kappa, and his J.D. from Columbia University Law School in 1991, where he was Senior Editor of the Law Review, a Harlan Fisk Stone Scholar, and winner of the Whitney North Seymour Medal for Trial Advocacy.  Mr. Eilender clerked for the Honorable Charles M. Metzner, United States District Judge for the Southern District of New York, from 1991 to 1992, and then for the Honorable Morton I. Greenberg, United States Circuit Judge for the Third Circuit Court of Appeals, from 1992 to 1993.  Before joining the Firm, Mr. Eilender practiced with Paul, Weiss, Rifkind, Wharton & Garrison.  He represents clients in securities, corporate governance, antitrust, insurance coverage, telecommunications, real estate, and intellectual property litigation and appeals. 

In this past year, Mr. Eilender won a signifcant victory in causing the Securities and Exchange Commission to withdraw its insider trading complaint against two of his clients in a civil proceeidng that the SEC had filed in the Southern District of New York. See SEC v. IRIS CAPITAL SECURITIES S.A.L. et al. SDNY, 11 CV-03794 (TPG). Mr. Eilender also negotiates employment contracts for employers and highly compensated executives and litigates employment disputes.  Currently, Mr. Eilender is lead counsel for AXA in a $200 million lawsuit that it brought agianst ING in the Supreme Court of the State of New York, New York County Commercial Division arising from the acquisition by AXA of a Latin American subsidiary of ING's; Mr. Eilender is also lead counsel for Cadila Healthcare Group and its chairman in defending a trade secret case brought against them by Mylan Pharamaceuticals in Vermont state court; and is lead counsel for a Chinese investment company suing its formers partners for breach of fiduciary duty in the New Jersey Chancery Division.  Recently, Mr. Eilender has prosecuted and defended several copyright and trademark infringement lawsuits for online personality Perez Hilton; and served as a lead counsel for Judith Regan in defense of a lawsuit brought against her by Dreier LLP, in which Mr. Eilender was the only attorney to depose Marc Dreier during the time he was under home confinement.

  • In response to succesful motion to vacate an asset freeze order, causing the SEC to withdraw its insider trading complaint (a rare occurence) in SEC v. IRIS CAPITAL SECURITIES S.A.L., SDNY 11-CV-03794 (TPG); obtained $1.5 million dollar judgment in bench trial concerning the vlaue of withdrawing LLC's member interest in MAN CHOI CHIU and 42-52 NORTHERN BLVD, LLC v. WINSTON CHIU, Sup. Ct. Queens, Cnty, Index Nos. 21905/07, 25275/07; obtained summary judgment on behalf of majority shareholder against minority shareoholders and former senior management of New Jersey close corporation for looting the company through false or undocumented business expenses, which result in large damage award and forfeiture of defendant's shares in the company under the New Jersey Shareholder Oppression Statute in GOLD RENOWN LTD. and VIEWMARK v. RAKOVITCH and TUSZYNSKI, Superior Court of New Jersey Chancery Division, Middlesex County(to our knowledge this is the first recorded instance of a court granting summary judgment based on the failure to document business expenses); made succesful motion to dismiss with prejudice on behalf of former board members of New York condo in employment discrimination suit brought in commercial division against them by former managing agent on ground that the neither of the individual defendants or the condo were the agent's employer in ROLINDA ANTONE v. SHORE TOWERS CONDOMINIUM, et. al., Sup. Ct., Queens Cnty., Index No., 103711/10; sucessfully defeated most significant portions of motion to dismiss in representing fortune 550 insurance company in $200 million lawsuit in commercial division against another insurance company arising from $1.5 billion acquisition of Mexican subsidiaries in AXA MEDITERRANEAN HOLDING, S.A v. ING INS. INT'L, B.V., Index No. 652110/10; successfully moved to quash service of complaint on largest generic pharamaceutical company in India and its CEO and Chief of Research in lawsuit brought in Vermont state court by u.S. pharamaceutical company for alleged trade secret misappropriation and violation of non-compete in MYLAN TECHNOLOGIES, INC. v. ZYDUS NOVELTECH, INC., Sup. Ct. Vt. Docket No. S41-09CnC.
