Mr. Diamante graduated from Cornell University in 1976 with a bachelor’s degree. He went on to receive his law degree from Brooklyn Law School in 1979. He holds licenses to practice law before all New York state courts, the U.S. Court of Appeals for the 2nd, 3rd, 4th and 6th Circuits, the U.S. Court of Appeals for the Federal Circuit, the Supreme Court of the United States and the U.S. International Trade Commission.

  • Resulting in one of the five largest patent awards to date, due mostly to the proving of willful patent infringement, Joseph Diamante, along with Stroock IP partners Kenneth Stein and Ian DiBernardo, represented Mirror Worlds LLC in an infringement suit against Apple, relating to patents co-invented by Yale computer science professor David Gelernter. On October 1, 2010, following a one-week jury trial in Tyler, Texas, Apple was ordered by a jury to pay up to $625 million in damages to Mirror Worlds for willfully infringing three patents concerning how documents are displayed on computer screens. These patents are owned by Mirror Worlds, a software business Gelernter founded. The technology in question is alleged to cover a substantial portion of Apple’s product line and the case may also be one of the largest patent infringement suits currently pending in the country. Most notable in this case is the Stroock team’s success in achieving willful patent infringement for client Mirror Wolds. Notable also is the court’s rejection of Apple’s attempt to exclude Stroock from participating in Patent Office re-examination proceedings filed by Apple., 1900
