(2017) - For the last six years, since the decision of Jude Rakoff in the Southern District of New York in Gupta v SEC, various challenges to the Securities and Exchange Commission’s (SEC) in-house administrative proceedings have been lodged. The challenges have taken different forms, including arguments under the Due Process, Equal Protection and Appointments clauses, but they all have a common theme: the SEC's administrative proceedings, which are overseen by Administrative Law Judges (ALJs), are constitutionally flawed.
