    Verdicts/Settlements:

    • Verdict against the United States Postal Service on behalf of the family of a 68-year-old woman who was struck and killed while riding her bicycle westbound on West 29th Street between 9th and 10th Avenues in New York City at approximately 12:00 p.m., on July 2, 2011. As the decedent and driver proceeded westbound, the postal truck moved to the right and struck the decedent as the truck attempted to pass. The defense presented two non party witnesses that claimed the decedent suddenly lost her balance as the truck passed her but that there was no contact between the truck and the decedent until the decedent had fallen to the ground and was run over by the right rear wheels of the truck.  Claim was made for loss of earnings, pension and social security benefits, loss of parental care and guidance to two adult children, loss of household services and funeral expenses. After a bench trial pursuant to the Federal Tort Claims Act, the magistrate found the United States of America 100% at fault for the happening of this accident. , 2015
    • Settlement - May 5, 2014$6,500,000Berta Leoncini v. New York City Transit Authority and Muhammad AyazIndex No. 25526/11Supreme Court of the State of New York, Queens County Plaintiff was an 80 yo woman, retired. Plaintiff was attempting to board a New York City Transit Authority bus. The bus pulled into the bus stop. Plaintiff claimed that the bus operator was looking to the left and closed the doors of the bus on her bag as she attempted to board and that the bus pulled away, dragged her to the ground injuring both of her feet. The defendant claimed that the plaintiff was running to catch the bus and tripped and fell on the sidewalk. The defendant denied there was any contact between the bus and the plaintiff. Plaintiff was taken by ambulance to Long Island Jewish Medical Center where she was treated for crush injuries to her lower extremities. The plaintiff underwent open reduction and internal fixation to both lower extremities., 2014
