    • Since 2005, I have handled everything from Jury Trials in Breach of Contract Actions (in particular, those involving matrimonial agreements) to Fraudulent Conveyance Actions.  I am a stickler for seeking out every viable cause of action in each case.  For example, in Kaprov v. Stalinsky, 2016 N.Y. Slip. Op. 08509 (2d Dept. 2016), one of the seminal issues was the Fraudulent Conveyance of a parcel of real property, on which I was victorious, and the other issue on which I lost was the fraudulent nature of certain loans on property, which were obtained by way of Confessions of Judgment.  In one of my cases for Breach of Contract, a Cause of Action I use somewhat regularly since agreements and Judgments are two separate instruments, an issue of first impression arose out of the use of an offer of liquidated damages, which is still in the process of being tried in the Supreme Court, Westchester County.  See, McMahan v. McMahan, 2016 N.Y. Slip. Op. 26291 (Sup. Ct., Westchester County 2016).  In addition, I have frequently litigated Battery and Assault Causes of Action, and have often relied on the provisions of New York’s Debtor and Creditor Law in actions involving Fraudulent Conveyances.  As a result of having to pursue every avenue of relief for my clients, I have even, unfortunately, had to commence actions against Attorneys, which also resulted in an issue of first impression being decided in my favor.  See, Khlevner v. Tylo, 2007 N.Y. Slip Op 51628(U), 16 Misc. 3d 1129(A) (Sup. Ct., Kings County 2007).  I take a holistic approach to the practice of Matrimonial and Family Law and will actually be commencing an action for violations of one of my client’s civil and constitutional rights in a Family Law Matter in the very near future.  I have come to understand that in order to effectively practice Family Law and Matrimonial Law, it is necessary not just to look at the usual issues that are typically raised in the context of an action for divorce, but rather to consider all of the relevant issues in a comprehensive manner.  For example, I have obtained relief for a client in a Child Support and Spousal Support Matter by commencing an action for Breach of Contract, while the other party was seeking to reduce support, because of the anticipatory repudiation of the parties’ settlement agreement.  Any improper change to the amount of support being provided to a spouse would result in damages and then also an award of counsel fees, if there is a default provision in the parties’ agreement.  By looking at all aspects of a case, you see what others miss.
