Joseph Bavaro joined Salenger, Sack, Kimmel & Bavaro in 1997, was named partner in 2007 and in 2010 became a name partner of the firm. As a successful litigator, Mr. Bavaro has brought numerous personal injury cases to successful verdicts while earning the respect of his peers and the judiciary. Two high-ranking judges, The Honorable A. Gail Prudenti and the Honorable C.   • Construction work is high risk, and accidents are a way of life. But much can be done to prevent the severity and frequency of on the job accidents by strictly following safety precautions and dilengent supervision of the work site.  Under New York State's Scaffold Law, which provides critical protection for the construction worker, the owner or general contractor are liable and responsible for providing a safe workplace. This includes an obligation to keep worksites free from debris, stray tools or supplies that might trip a worker.   • It is widely known that a plaintiff must serve a notice of claim upon a municipality in New York state within 90 days of an incident in order to preserve the right to later file a lawsuit against the municipality arising out of that incident. General Municipal Law (GML) §50-e(1). With respect to the claims of false arrest and malicious prosecution, however, confusion arises because both claims often originate out of the same occurrence, false arrest being the more damaging of the two in terms of reputation and repercussion. However, the critical fact is they are two separate and distinct causes of action, and accordingly, they have different elements and notably different deadlines for filing a notice of claim.
