    Attorney Profile

A partner at Blustein, Shapiro, Rich & Barone, LLP, Gardiner S. Barone focuses his practice primarily on complex business matters. He works out of the firm's offices in Goshen, New York, and he represents clients throughout Orange County and the surrounding region, including part of the greater New York City metropolitan area. Mr. Barone has been admitted to practice in New York since 1988, and he is also admitted to practice before the U.S. District Courts for the Northern and Southern Districts of New York as well as before the United States Court of Federal Claims. Highly regarded by his colleagues for the superior quality of his work, he has received a Distinguished* peer review rating through Martindale-Hubbell.

Mr. Barone's practice has involved a variety of business disputes that he has been able to resolve successfully in favor of his clients, both in the courtroom and as a result of him negotiating favorable settlements with attorneys representing the other parties. One representative matter concerned the potential dissolution of a family-owned business that was worth millions of dollars, and he was able to settle the case with his client purchasing the ownership interest of the dissenting shareholder who retained a security interest. This allowed his client to avoid a potentially protracted and costly trial.

Mr. Barone also represents several municipalities, and he has provided advice and counsel to commercial real estate developers on land use and zoning issues. He attended Thiel College as an undergraduate, where he majored in philosophy and political science and received a Bachelor of Arts in 1984. Mr. Barone's legal education was obtained at Albany Law School, and he was awarded his Juris Doctor in 1987.

    • In a hotly contested business dispute involving multiple business locations in several states, that were run without an agreement that designed how any disputes were to be resolved between the partners, I was able to negotiate a settlement whereby some of the assets were sold to third-parties and my client acquired the remaining assets, debt-free. Again, this was accomplished without engaging in extensive discovery and depositions, so significant legal fees were avoided., 2017
    • After securing a pre-answer dismissal of an action to force the dissolution of a multi-million family owned business, I negotiated a settlement whereby my clients purchased the dissenter’s ownership interest in the business and real property by financing the acquisition price with the dissenter holding a mortgage on non-business real property. Tens of thousands of dollars were saved by avoiding costly and prolonged litigation., 2017
