Matthew A. Toporowski is the founding attorney of Toporowski Law, PLLC, an Albany, New York litigation boutique. Matt represents businesses, property owners, homeowners and condominium associations, employers and employees, and municipalities in high-stakes disputes throughout New York — focusing on commercial litigation, real estate disputes, HOA and condominium matters, employment and labor law, and municipal law.
In business and commercial litigation, Matt represents owners, shareholders, and companies in disputes involving breach of contract, breach of fiduciary duty, fraud, theft of trade secrets, and non-compete agreements. The subject matter is as varied as the forum — from polymers and mutual funds to advertising and startups — and he has appeared before the American Arbitration Association (AAA), the Financial Industry Regulatory Authority (FINRA), and in state and federal courts throughout New York, as well as on behalf of clients' interstate interests in other states.
In real estate and community-association matters, Matt litigates failed closings and disputed deposits, specific performance, boundary, easement, and quiet-title actions, partition, construction defects and mechanics' liens, and commercial landlord-tenant disputes. He represents homeowners associations and condominium boards in disputes with developers, contractors, and vendors, including covenant enforcement, assessment collection, and construction-defect claims. A licensed New York real estate broker and active real estate investor, Matt brings practical, market-level insight to property disputes.
In employment and municipal matters, Matt represents both employers and employees in claims involving discrimination, harassment, retaliation, wrongful termination, wage-and-hour disputes, severance, and restrictive covenants, and he handles labor proceedings — including collective bargaining, civil service, and Public Employment Relations Board (PERB) matters. On the government side, he represents towns, villages, and public entities, defending Article 78 proceedings and the validity of local laws and advising on FOIL and Open Meetings Law.
Matt is a former Assistant District Attorney in Albany County and a former law clerk to the Justices of the New York State Appellate Division, Third Department. He has tried cases in the Commercial Division, handled FINRA and AAA arbitrations, and helped defend a $7 million verdict on appeal, and he has served as a Senior Assistant Corporation Counsel for the City of Albany. He is admitted in New York and Pennsylvania and before the U.S. District Courts for the Southern, Northern, and Eastern Districts of New York. Matt earned his J.D. cum laude from New York Law School, where he served on the Law Review, and his B.A. cum laude from The College of Saint Rose. His experience as a prosecutor, appellate clerk, and commercial litigator allows him to try cases and defend verdicts on appeal.
