As managing partner and founding member of Kaufmann Gildin & Robbins LLP, Daniel Gildin is committed to representing clients in New York City, across the state of New York and throughout the United States. He focuses his practice on handling cases that involve the following matters: business litigation, real estate, franchising, entertainment, estate planning and appeals.
After receiving an undergraduate degree from Case Western Reserve University, Mr. Gildin went on to earn a law degree from Fordham University School of Law in 1977.
Leading the law firm’s litigation department, Mr. Gildin has more than 35 years of experience representing a variety of clients, including tenants who are disputing a commercial leasing transaction with mall owners. He has the legal knowledge to handle even the most complex cases and takes a focused approach to every matter. On behalf of clients, he tenaciously litigates in the courtroom or negotiates to reach a settlement that is of the greatest advantage to them. In order to secure the best possible outcome, Mr. Gildin works closely with clients to understand their goals for their case and keeps them informed throughout the legal process. A member of the New York State Bar Association, Mr. Gildin is admitted to practice before New York’s state courts, the U.S. District Court for the Eastern District of New York, the U.S. District Court for the Southern District of New York, the U.S. District Court for the Northern District of New York and the U.S. District Court for the Western District of New York. Active in the legal community, he is a member of the American Bar Association.

- The firm defended numerous clients against an arbitration proceeding commenced by prior counsel (one of the largest and most prestigious litigation forms in the country) for allegedly unpaid legal fees. Award entered for approximately 1% of the amount demanded. , 2024
- On behalf of a nationally recognized business strategy coach, successfully defended claims that a signed term sheet constituted a binding and enforceable agreement, rather than an unenforceable “agreement to agree”, leading to settlement of all claims on favorable terms., 2019
- On behalf of a Singapore-based licensee of an international indoor skydiving equipment manufacturer/licensor, defeated the claims of the licensor in an international arbitration forum seeking to block the client from purchasing equipment from other sources and successfully prosecuted counterclaims seeking (i) a declaration that the parties’ agreement terminates on a date certain and (ii) an award of significant attorneys’ fees., 2019
- Representing a real estate brokerage franchisor/defendant, obtained summary judgment in a case filed by 3 franchisees involving common law and statutory claims related to franchise disclosure. The Court granted summary judgment dismissing the statutory claims (a ruling of first impression under both the NY and Rhode Island statutes), and further limited plaintiffs’ sole remaining common law claim, making settlement on extremely favorable terms inevitable., 2015
- Representing the limited partnership owner of a multi-unit residential property, obtained summary judgment declaring that the execution by a limited partner of an agreement granting a purported interest in the real property was unauthorized and, therefore, void., 2018
- Representing a luxury furniture franchisor, successfully moved at the pleading stage to dismiss a AAA arbitration proceeding commenced by a franchisee claiming wrongful termination without cause under the Dealership Agreement and the Illinois Franchise Disclosure Act and Illinois Consumer Fraud and Deceptive Business Practices Act and obtained an Award for unpaid royalties which was confirmed in the US District Court for the Southern District of New York., 2011
