Mitchell D. Frankel is a co-founding partner at Sussman & Frankel, LLP located in Midtown Manhattan. For more than 34 years, Mr. Frankel has specialized in all types of personal injury litigation and general/commercial disputes including wrongful death actions, construction site accidents, premises liability, automobile, bus and train accidents, elevator/escalator incidents, hospital and physician malpractice, toxic mold, asbestos, lead poisoning, defective products, nursing home neglect, and more.
Mr. Frankel also represents a variety of business clients, including large, medium and small corporations, as well as individuals, concerning contractual disputes, non-compete provisions, breaches of fiduciary duty, partnership and shareholder disputes, insurance issues, tort related claims, debtor/creditor matters, commercial collections, and more.
Mr. Frankel has successfully handled and tried numerous cases in the state and federal courts throughout the New York metropolitan area, recovering many millions of dollars in settlements and jury verdicts for his clients, including a 5 million dollar resolution of a medical malpractice action. In addition to being a skilled trial lawyer, Mr. Frankel also has valuable appellate experience successfully handling several appeals before New York's appellate courts.
In 1987, Mr. Frankel graduated with Honors from the State University of New York at Binghamton with a Bachelor of Arts in economics and in 1990, received his law degree with Honors from The George Washington University Law School. He is admitted to the bar in New York, Connecticut, the District of Columbia and the federal courts situated in the Southern and Eastern Districts of New York. He is a member of the New York State Trial Lawyers Association and has served as a member of the prestigious Judiciary Committee of the Association of the Bar of the City of New York.

- Many millions of dollars have been recovered for clients over the years, including jury verdicts and settlements up to $5 million dollars. Most recently, a settlement was obtained for $2.5 million dollars for a person who sustained serious neck and back injuries, as well as other damages, resulting from being struck by a piece of fallen sidewalk scaffolding.

- Successfully obtained a ruling by the Appellate Division, First Department, reversing the lower court's ruling granting summary judgment dismissing plaintiff's complaint as against the operator of a camp for disabled individuals and reinstating the main claim against the camp operator which involved the failure to erect safety or guard rails along a pathway situated next to an embankment, which would have restrained plaintiff when he slipped, and prevented him from falling down the embankment and sustaining, among other things, serious facial fractures requiring surgical repair. See, Aberger v. Camp Loyaltown, Inc., 142 N.Y.S.3d 528,193 A.D.3d 195 (1st Dept. 2021).
- Successfully obtained a ruling by the Appellate Division, First Department, affirming the unanimous jury verdict on liability and damages obtained against the New York City Transit Authority for the sum of $522,000.00 for a torn ankle ligament injury suffered as a result of a trip and fall in a subway station. See, Grace v. New York City Transit Authority, 123 A.D.3d 401, 998 NYS2d 36 (1st Dept. 2014).
- Successfully obtained a ruling by the Appellate Division, Second Department, upholding a decision and Order of the Supreme Court, Queens County, denying defendant's motion to dismiss plaintiff's Complaint for lack of personal jurisdiction, and granting plaintiff's cross-motion for an extension of time to serve defendant with an Amended Complaint in a dental malpractice action, thereby defeating defendant's appeal. See, Owens v. Chhabra, et. al., 72 A.D.3d 664, 897 N.Y.S.2d 912 (2nd Dept. 2010).
- Successfully appealed to New York State's highest court to reverse the ruling by the Appellate Division, First Department, which upheld a decision and Order by the Supreme Court, New York County, in a medical malpractice action. This ruling by New York's highest court made new law in the area of venue selection in New York State. See, Saxe v. Ob/Gyn Associates, 633 N.Y.S.2d 471, 86 N.Y.2d 492 (1995).
