- Most attorneys write a Notice Pleading (i.e., a simplified Complaint to merely comply with the law to give "notice" of the claim). In my opinion, this is a lost opportunity and mistake. I lectured with a great Lawyer, who is Josh Silber, Esq.; he wrote his own materials, and I wrote mine. In my Introduction, I wrote: "What I found that works for our law firm, does not work for everyone. What is said in our Complaint, Bill of Particulars (“BP”) and Expert Response(s) is very similar. I am a true believer to “upload” everything at the outset; do the nitty gritty hard work at the outset. The reason you do the hard work up front is, then, when you prepare your BP, you just copy and paste the negligence portion etc, right from your Complaint, and the same thing from the BP into your Expert Response. Why not do it from the outset? Why pass the buck until later? Think of your Pleading as the “foundation” of your entire case; if you have a strong foundation, the case will withstand every attack. Also, when you think the case through, at the outset, you will also know what to ask for from your investigator, your Expert, the defendant in a Demand for Discovery, FOIL request or Subpoena. Think of the case, not solely by the task at hand, but in its entirety from the moment you get the case.", Writer and Lecturer, Pirrotti's Guide to Pleading - 2023, New York State Trial Lawyers Institute (NYSTLI), Attorneys, 2023
- Premises Liability cases are won or lost at the deposition and discovery phase. There is an "art" to conducting discovery and these depositions. The focus of the writing and presentation was how to find and mine the evidence necessary to prove your case, starting from your investigation, FOIL Requests, the detail of the Complaint, proper Discovery Demands, proving spoliation, the importance of an Expert, proving Habit, Camouflage conditions, Building Codes, Industry Standards, etc. , Writer and Lecturer, Evidence to Win - Premises Liability, New York State Trial Lawyers Institute (NYSTLI), Attorneys, 2023
- In our Industry, there are famed Trial Lawyers over the centuries. Henry Miller, Esq was one of them. Ironically, he was also an actor, and he played Clarence Darrow, Esq., another famed Lawyer. Henry, known as the "Dean" of Trial Lawyers, Past President of the NYS Bar and consistently obtaining incredible results for his clients, along with sharing his knowledge in countless CLE's, made Henry, "Henry". I interviewed dozens of Judges and Lawyers, and created this Article, so that the loss of this great man may never be forgotten. He practiced law until he passed away unexpectedly from Covid-19. , Writer, "Grieving, Honoring and Celebrating the Life of Henry Miller, Esq.", Westchester Bar Journal, Volume 45, No. 1, Attorneys, Judiciary And Court Attorneys, 2020
- Too often, attorneys do not adhere to the New York Court Rules regarding conduct at depositions, and the limited direction to not answer a question under 22 NYCRR Part 221.2. Many Judges also are unaware of the Rules regarding when an attorney can direct a client not to answer a question, or that an attorney can lead a witness at a deposition, or ask expert questions of a witness, etc. The purpose of the article was to cite statutory and decisional Appellate Case Law to clarify what can and cannot be done., Writer, Deposition Rulings Pursuant to the Uniform Rules for NYS Courts and CPLR 3113, Westchester Bar Journal, Volume 47, No. 1, Attorneys, Judiciary And Court Attorneys, 2023
