Jonathan D. Mester focuses his practice on representing victims of medical malpractice, including obstetrical malpractice cases in which the baby suffers severe deficits at birth including Cerebral Palsy and Erb’s Palsy. Jonathan also handles construction accident cases involving serious injury and death.
Jonathan joined Nurenberg, Paris, Heller & McCarthy in 1998 as an associate and today is the managing partner with the firm, and a member of the firm’s board of directors. He is a member of the Million Dollar Advocates Forum. Jonathan has also been selected for inclusion in Ohio Super Lawyers® by Law & Politics Media since 2010. - Delivery of full term baby. Primary allegation was the obstetrical nurses failed to inform OB/GYN of deteriorating fetal heart tracings which required delivery by emergency C-section. Case settled for $4,000,000., 2023
- Baby born with intrauterine growth restriction (IUGR) and mild to moderate hypoxic ischemic encephalopathy (HIE). The allegations in the case were delays in evaluating the mother who had presented to her doctor with complaints of decreased fetal movement on the morning of the emergency c-section delivery, and failure to diagnose IUGR during the prenatal period. Case settled for $3 million, 2022
- Plaintiff’s decedent was working for a subcontractor on a project involving construction of a new hotel. Plaintiff’s decedent entered an elevator shaft and stood on a wood platform which had been erected by a fellow subcontractor at the direction of the general contractor. Plaintiff’s decedent then fell through the platform after he stepped on the section towards the end of the platform, falling 4 stories to his death. Discovery revealed that the platform had been changed due to a failure to meet initial specifications, and that the side of the platform was ultimately improperly constructed. Case settled for $5,000,000.00, 2021
- Plaintiff was a patient of the defendant neurosurgeon. The allegation was a failure to timely diagnose a condition known as a spinal AVM, which is a very rare condition which was not present initially on imaging. As a result, there was a delay of several months in making the diagnosis, during which time Plaintiff’s condition deteriorated significantly. He is now in a wheelchair with permanent bowel/bladder issues. Case settled for $2,000,000.00, 2019
