    Attorney Profile

Richard H. Nemeth is the founder of Nemeth & Associates, LLC, located in Cleveland, Ohio. Providing representation to clients throughout the state, he focuses his practice on consumer and small business bankruptcy and other forms of debt relief. Mr. Nemeth also assists businesses and homeowners who are seeking to avoid foreclosure, and he has represented borrowers in litigation against mortgage loan originators, brokers and services in cases involving fraud, violations of the Fair Debt Collection Practices Act and Truth in Lending issues.

As an undergraduate, Mr. Nemeth received a Bachelor of Arts in geological science from Case Western Reserve University in 1978. He then attended Cleveland-Marshall College of Law at Cleveland State University and was awarded his Juris Doctor in 1984. Following law school, Mr. Nemeth spent 2 years as general  counsel to an oil and gas producer before entering private practice. Admitted to practice in Ohio, Mr. Nemeth is also admitted to practice before the U.S. District Court for the Northern District of Ohio, the U.S. Court of Appeals for the 6th Circuit and the Supreme Court of the United States. Highly regarded by his fellow attorneys, as evidenced by his receipt of a "Superb" peer review rating through Avvo, he is frequently asked to make presentations on bankruptcy topics at continuing legal education seminars across the country. In 2008, Mr. Nemeth spearheaded an effort to modernize the Ohio state exemption law that sets forth what property is out-of-the reach to creditors.  He was the lead witness before the Senate committee that considered the bill, testifed before the House committe and marshalled witnesses from accross the state to provide proponent testimony. The bill passed against heavy odds, and Mr. Nemeth received national recognition for his efforts. Mr. Nemeth has also testified as an expert witness in the area of bankruptcy law.

Mr. Nemeth is involved in multiple professional organizations. He is currently serving his second term on the board of directors of the National Association of Consumer Bankruptcy Attorneys, and is also a member of the Ohio State Bar Association, the Cleveland Metropolitan Bar Association, and the National Association of Consumer Advocates.
