The Supreme Court of Ohio held that when a criminal defendant who has successfully completed a program of intervention in lieu of conviction (ILC) moves for an order sealing his or her record under R.C. 2951.041(E), the trial court has discretion either to grant the motion immediately under R.C. 2953.52(A)(1) or to impose a waiting period before the record is sealed pursuant to R.C. 2953.32(A)(1).
  • State v. Wyatt: The defendant was charged with abduction, a felony, with a gun specification. He was facing a mandatory four years in prison with a potential maximum sentence of eight years if convicted. He was also charged with misdemeanor domestic violence and aggravated menacing. Following a jury trial, the defendant was found not guilty on all counts.
  • State v. Tillis: My client was a passenger in a vehicle that was stopped by the police. Following a search of the vehicle, the officers discovered cocaine and my client was charged with possession of drugs.
