John P. O’Neil is a partner at Elk + Elk and focuses his practice on medical malpractice and catastrophic personal injury cases involving death and serious injury. He has tried more than 80 jury trials in state and federal courts, including cases involving medical negligence, transportation, legal malpractice, premises liability, and other complex claims.
Before joining Elk + Elk in 2012, John spent 14 years at a leading Ohio defense firm, where he served as a practice area chair and member of the firm’s management and executive committees. He also served as a prosecutor in the Dade County State Attorney’s Office in Florida.
John has litigated cases throughout Ohio and has argued before the Eighth District Court of Appeals, the Supreme Court of Ohio, and the United States Court of Appeals for the Sixth Circuit.
His case results include multiple multi-million-dollar verdicts and settlements in cases involving trucking accidents, catastrophic injury, wrongful death, and medical negligence, including recoveries of $6.7 million, $5 million, and $4 million in complex injury and fatality cases.

- $5 million: Loading/unloading accident in Indiana, which caused catastrophic brain injury.
- $1 million: Wrongful Death of an eighty-year-old man who was struck and pinned by a box truck while getting gas. He suffered severe crush injuries and passed away weeks later from complications related to the trauma.
- $6.7 million: A 38-year-old woman had her lower extremity run over by a limousine bus. She suffered many fractured bones in her foot and a subsequent infection.
- $5 million: Our client, a 26-year-old dump truck driver and father of one minor child, was struck at a rural intersection when another truck ran a stop sign. He suffered a severe cervical injury, which required surgery, but resulted in partial paralysis of his upper extremity. He is no longer able to work as a CDL driver.
