Verdicts/Settlements:

  • $323,000 – Motor vehicle accident results in multiple injuries (May 2010) Defendant’s flatbed truck went left of center and hit Plaintiff. Plaintiff sustained lumbar radiculopathy, lumbar disc displacement, right wrist fracture and a triangular fibrocartilaginous complex tear, which required surgery., 2010
  • $220,000 settlement at mediation after completion of discovery.  Plaintiff was working as a flagman in a construction zone when he was struck by an 18 year old driving to high school.  Plaintiff suffered from multiple, partial tears in his shoulder and a torn labrum in his hip.  The settlement represented substantial exhaustion of policy limits, and the BWC subrogation interest was successfully reduced from approximately 164,000 to 43,000 maximizing the Plaintiff's net recovery.  His workers compensation claim remains open., 2018
  • $550,000.00 settlement.  Plaintiff suffered from a mild traumatic brain injury (concussion), cervical Strain, and a right shoulder contusion as a result of being struck by a tractor trailer while Plaintiff was operating a school bus.  The post-concussive syndrome resulted in increased anxiety, memory loss, depression and persistent vertigo.  The settlement was reached prior to filing suit, but litigation was initiated to resolve the self-insured, workers compensation subrogation lien., 2018
  • $108,000.00 settlement - Individual suffered a broken ankle when an free standing, brick wall fell over on her leg at an apartment complex she was visiting. The injured party had surgery to place hardware in her ankle, and subsequent surgery to remove the hardware. Defendant alleged comparative fault against the claimant., 2015
  • $315,000.00 settlement for a 58 year old male who suffered from a high velocity hip dislocation and fracture with surgical repair in a disputed liability automobile accident., 2009
  • $990,000 – Plaintiff was stopped on road and struck by another vehicle causing multiple injuries, including fractures to the shoulder, humerus and ankle, with severe laceration to the arm and an aggravation of a prior lung disorder. (March 2016), 2016
  • $110,000.00 settlement for a traffic control officer who was struck by debris at a construction site due to an employee of the defendant improperly using machinery.  The officer suffered a laceration to the neck partially severing a vein in the neck; and, a disputed tear in the shoulder.  Liability and causation were both disputed.  , 2017
  • $62,000 VERDICT in Marion County, Ohio.  Plaintiff suffered chronic soft-tissue injuries with extensive chiropractic treatment following an eight month gap in treatment.   Defense counsel disputed the extent of injuries and causation.  The last offer before verdict was $20,000., 2009
  • $100,000.00 policy limits settlement for a pedestrian who was struck by an off-duty police officer while crossing the street, not within a sidewalk.  Liability was disputed., 2009
  • $250,000 – Motor vehicle accident results in internal bleeding (December 2010) Plaintiff was a passenger in the Defendant’s vehicle that lost control and struck a median. Plaintiff suffered multiple fractures, bruising and contusions and internal bleeding., 2010
  • $210,000.00 settlement - Woman slipped and fell in the bar area of an establishment. She fractured her shoulder, ribs and knee. She completed all of her treatment within a year of the incident. The amount accepted as payment in full of her bills was under $24,000.00. Defendant claimed lack of notice of the substance on the floor on which she fell., 2015
  • $700,000 settlement (pre-litigation) for a woman who was a passenger in her husband's vehicle when struck by a passing vehicle as Plaintiff's vehicle turned left.  There were allegations that her husband was making an illegal u-turn, and caused the accident.  She suffered severe lacerations and degloving injuries to her forearm and hand.  After numerous surgeries, she was left with limited use of her non-dominant hand., 2009
  • $175,000.00 settlement - Individual was injured when Defendant failed to yield at a stop sign. She had a significant prior history for bowel obstructions and other abdominal surgeries. Approximately two weeks after the incident, she developed a complete bowel obstruction. There was a dispute as to causation of the delayed onset bowel obstruction. Defendant argued she suffered only soft tissue injuries, and retained a medical expert to testify to the same., 2014
  • $300,000.00 settlement in Scioto County, Ohio.  The primary injury was a recurrent tear of a rotator cuff that had been previously repaired less than a month before he was rear-ended., 2017
  • $190,156.17 VERDICT for an automobile accident in Franklin County, Ohio.  One plaintiff suffered a cartledge injury to his right wrist, and the other plaintiff aggravated pre-existing foot and ankle conditions requiring additional surgery.  Offers were 67,500 before verdict.  Prejudgment interest and costs were also recovered.  This was the largest auto accident verdict in Franklin County in the calendar year 2009., 2009
  • $100,000.00 policy limits settlement of wrongful death case.  Liability was heavily disputed as both sides maintained that the other driver crossed the center line of a two-lane country road.  Each version was supported by retained experts., 2009
  • $200,000.00 for a 3 year old female who was attacked by a dog.  She suffered facial lacerations and wounds resulting in permanent scarring to her check.  The scar was fading significantly at the time of settlement., 2009
  • $1.4 Million (March 2014) - A 14 year old bicyclist was run over by a school bus, and the driver fled the scene. His injuries included a skull fracture, cranial nerve injury, and a severely broken leg requiring multiple surgeries. The statutory caps on non-economic damages (because the defendant was a political subdivision) was an obstacle to recovery., 2014
  • $302,166.67 settlement (post-mediation) - Defendant truck driver was attempting to make an illegal u-turn, and pulled into the path of the vehicle in which Plaintiff was riding. A high speed impact resulted in fractures to the femur and tibia-fibula requiring internal fixation. The injured person made a good recovery, and the physicians indicated that he would not have any long term effects from the fractures. The truck driver attempted to blame the other driver., 2015
  • $165,000 settlement for a motorcycle accident resulting in bilateral fractures of the clavical requiring surgical repair., 2009
  • $111,203.34 confessed judgment (at mediation) - Plaintiff was a passenger in a taxi when the driver lost control and struck a tree. The driver attempted to assert a sudden medical emergency defense. There were also significant coverage issues for the insurance/bond of the taxi company. Plaintiff fractured her C2 vertebral body, but had no neurological deficits. She passed away from unrelated causes approximately 10 months later. The taxi company became insolvent and payment was recouped through Plaintiff’s uninsured motorist and medical payments coverages., 2015
  • $150,000.00 policy limits settlement for a motorcyclist who suffered a tibial plateau fracture after another motorist failed to yield right of way at a stop sign.  The fracture required surgery with the use of an external fixator as well as repairing damage to his knee., 2017
  • $121,184 settlement for a severe, and deep laceration to the forehead of a 53 year old female.  Plaintiff struck her head against the windshield of her car after striking a commercial vehicle that failed to yield right of way.  The wound was successfully repaired with plastic surgery, and any scarring that remained was not visible because it was above the hair line.  Defense argued comparative negligence for failure to properly wear safety restraints., 2009

Transactions:

  • $900,000.00 settlement (at mediation).  Individual was rear ended by a commercial tractor trailer resulting in a fracture to his left hand, arthroscopic surgery to the right knee, and back and neck injuries with the implantation of a spinal cord stimulator.  Defendant disputed the nature and extent of the injuries, and the reasonableness of the medical care.  Defendant also argued that there was a subsequent, intervening accident responsible for his injuries., 2012
