  • Successful verdict in several civil complex civil matter for 75% of amount requested in complaint --primarily for non-economic damages. Verdict was eventually set aside by court. Case is under appeal. Melby v. Smith, 2011

  • $85,000 Contempt Judgement--Keller vs Lacy. Obtained substantial contempt judgment against landowner who was refusing to follow Injunction ($500.00 per day).  Was one of the largest contempt judgments on record in the Jurisdiction.  Affirmed by the Oregon Court of Appeals in 2010., 2007
  • USA v. Grants Pass Irrigation District Major Endangered Species Act Enforcement action--was one of the attorneys representing the defendant.  Engaged in settlement activities with multiple parties in complex case involving water rights and federal ESA injunction rights. Case was mediated with two federal judges.  Case eventually was resolved to insure irrigation to 7,000 irrigators by requiring parties to secure Savage Rapids Dam removal with federal funding.  The dam was eventually removed in 2010., 2001
  • Successful Defense Verdict (only nominal damages awarded)-(Parties Names Withheld as Settlement on appeal was confidential) Defended case  nominal damages against plaintiff seeking damages against plaintiff for accidental killing of pet.  Emotional case for all parties but was able to focus jury on legal issues., 2006
  • Represented client is suit against Bankers Life (Fallow v. Bankers Life, Inc) in federal court and obtained a 6 figure combined Summary Judgment and attorney fee award in clients favor. This decision is the framework for a multi-million dollar pending Class Action lawsuit against Conseco and Bankers Life on behalf of thousands of policy holders., 2013
