  • $12 Million Settlement of Neonatal Malpractice Case Attorneys Daniel S. Weinstock and Andrew K. Mitnick secured a $12 million settlement on behalf of the family of a child with kernicterus and cerebral palsy, resulting from the negligence of several pediatricians and neonatologists during the child’s first week of life. The case was settled during the fourth day of trial in a Miami, Florida courtroom. At defendants’ insistence, the names of the parties is being kept confidential. $4.2 million jury verdict A Philadelphia jury has awarded $4.2 million in the case of a woman who was run over by a motorist as she walked by a Toyota car dealership parking lot. Plaintiff Emilia Rosypal — who was 74, according to plaintiff's papers — was walking from her home toward Route 313 in Doylestown, Pa., as driver Alan Burroughs III made a left turn into the driveway of the Thompson Toyota car dealership Aug. 3, 2009, striking Rosypal. Both of Rosypal's legs were broken, her arms also were injured and her spine and hip also were injured.  The jury rendered its verdict Jan. 21, 2011.  $8.5 Million Settlement of Neonatal Malpractice Case Attorneys Daniel S. Weinstock and Andrew K. Mitnick secured an $8.5 million settlement on behalf of the family of a child with kernicterus and cerebral palsy, resulting from the negligence of hospital staff and pediatrician several pediatricians and neonatologists during the child’s first week of life. $5.75 Million Settlement of Birth Injury Case   Attorneys Daniel S. Weinstock and Andrew K. Mitnick secured a $5.75 million settlement on behalf of a child with cerebral palsy, resulting from the negligence of an obstetrician during birth admission. Settlement of Birth Injury Case Attorneys Daniel S. Weinstock and Andrew K. Mitnick secured a $6 million settlement in an Illinois birth injury case.  The case involved a woman who arrived at the hospital in labor after a normal, uncomplicated pregnancy.  Attorneys Weinstock and Mitnick argued that the fetal monitoring strips showed the development of excessive uterine activity, ultimately leading to non-reassuring fetal heart rate patterns.  The physician and nurses failed to recognize that the baby was becoming compromised, and made no effort to resuscitate or expedite delivery. Consequently, the baby was asphyxiated at birth and developed cerebral palsy. The settlement will provide for the child’s future medical care and other related needs.
