Brett N. Benton

Brett N. Benton is a partner at Ochroch Benton, P.C. who represents policyholders in complex insurance coverage, insurance recovery, and bad faith disputes. He also represents businesses and individuals facing significant liability claims and insurance coverage disputes in state and federal court. He has practiced with the firm since 2005.  

Brett brings a combination of litigation experience and insurance-industry knowledge to his practice. In addition to earning an LL.M. in Trial Advocacy, he holds the Chartered Property Casualty Underwriter (CPCU®) designation. This background allows him to approach coverage disputes with an understanding of both the legal issues presented by an insurance policy and the practical considerations involved in the handling and resolution of insurance claims.  

Insurance Coverage and Recovery

A substantial part of Brett’s practice is devoted to representing policyholders in disputes with insurance companies. He represents individuals and businesses in matters involving disputed liability claims and has successfully challenged liability coverage denials to obtain defense and indemnification for his clients. His experience includes claims arising in the construction, property development, and transportation industries.  

Brett also represents policyholders seeking recovery of insurance benefits, including substantial property and health insurance claims. His practice includes litigation involving insurance coverage and, where appropriate, claims concerning an insurer’s handling of its obligations to its insureds.  

Representative Matters

Brett’s insurance practice has included significant individual and class-wide recoveries, including:

• Obtaining a significant recovery of insurance proceeds on behalf of an oil refinery following a major industrial fire.  
• Serving as co-class counsel in litigation resulting in a $1.5 million recovery for approximately 3,500 Pennsylvania automobile policyholders.  
• Serving as co-class counsel in litigation resulting in a settlement exceeding $3 million on behalf of insureds diagnosed with head, neck, and brain cancers who had been denied coverage for Proton Beam Therapy treatment

Education and Professional Credentials

Brett earned his B.A. in Political Science from the University of North Carolina at Charlotte and received his J.D., with honors, from the University of Pittsburgh School of Law in 2004. In 2010, he earned an LL.M. in Trial Advocacy from Temple University’s Beasley School of Law. He is admitted to practice in Pennsylvania and New Jersey and holds the Chartered Property Casualty Underwriter (CPCU®) designation.  

Community Involvement

Brett serves as Board Chair of Child and Youth Advocacy Network of Pennsylvania and as a volunteer attorney with the Philadelphia Support Center for Child Advocates, where he represents children in dependency proceedings.
