Shortly after filing suit in federal court, Rachelle obtained a voluntary temporary restraining order from a former executive of a fast-growing consulting client who left and started a competing business. Subsequent negotiations during court-sponsored mediation resulted in a sizable settlement payment and permanent injunction favorable to our client. The process was completed quickly, in the span of a few months. 2. When a firm client in the music technology and consumer electric products industry was accused of patent infringement, Rachelle was part of the D&S team that filed a declaratory judgment suit in Florida. The opponent moved to dismiss the Florida suit, but D&S attorneys prevailed, obtaining dismissals of infringement suits filed in Florida and Washington on the same patent. 3. Rachelle represented an insurer on behalf of a property owner in a case where the owner of an exclusive, high-income residential neighborhood on the waterfront prevailed on all accounts on summary judgment. The easement was brought by a trust seeking to prevent the property owner from using an express, recorded easement. 4. Rachelle and the D&S litigation team obtained summary judgment disposing of multiple claims asserted against the firm’s Fortune 100 client, a multi-billion dollar financial corporation, in a multi-district patent litigation pending in the Central District of California related to automated attendant, automated call distribution, and voice response units.
