- In the past few years, I have resolved cases for many clients as the plaintiff, with recoveries ranging from hundreds of thousands of dollars to many millions of dollars. During the same time, I have represented defendants in settlement and trial of claims ranging from relatively modest value to claims valued in the tens of millions of dollars where we won a defense verdict which was affirmed on appeal.
- Duffy & Young represented DeBordieu Colony Community Association in an effort to intervene in an action by an entity that sought to claim title to 8000 acres of tidelands abutting the southern boundary of the DeBordieu Community, alleging a chain of title for the various parcels tracing back to grants of rights from the King of England. DCCA sought to aggressively defend against that claim and thereby keep public access to the tidelands and asserted a claim for a prescriptive easement over property at issue. The matter of intervention was the subject of an appeal, and we won. The appellate decision clarified the standard for intervention in South Carolina. And as a result of that success and a discussion with opposing counsel, the parties are discussing a negotiated resolution.
