  • 2022-CP-10-02997 Toby Tyler v. Robert B. Gilmore, et al. Our recently retired clients decided to build their final home on Seabrook Island, South Carolina.  They selected a homebuilder who they trusted and began to build a custom home at the beach.  They experienced some difficulties with the builder along the way, but the real issues began to develop as they approached the finish line.  Despite paying the builder every dollar it billed them for, our clients learned that subcontractors were not being paid, suppliers were not being paid and then the builder simply refused to finish the project. We were hired to demand that the builder pay its subcontractors and finish the project.  The builder went radio silence and our clients finished the project with their own funds.  The builder then had the nerve to sue our clients for funds purportedly never paid to him, despite the fact that our clients paid the builder all fees billed to them, the builder did not pay subcontractors and suppliers and did not finish the project. We demanded that the builder dismiss its suit or we would seek attorney’s fees and costs, as well as all damages owed to our client.  The builder and his attorney refused.  We engaged in initial discovery and found out that the builder could not prove that he spent the actual costs on the home that he charged our clients.  The builder could also not prove that he was owed anything.  In fact, the records showed our clients overpaid. We moved for summary judgment before the Court and were awarded judgment in the favor of our clients and the Court awarded our client all attorney’s fees and costs spent dealing with this so called “builder.”, 2024
  • I represented the family in the death of their child who was killed while driving a motorcycle.  We were able to obtain the policy limits of all available insurance from the at-fault driver's carrier as well as all available underinsurance, as well as stacking of those policies.  , 2024
  • Hinckley, as a member of and on behalf of Cavysi, LLC v. Emanuele, 2:23-cv-06506-DCN. I represented a leading telecommunications company and its majority member against a minority member, who breached many fiduciary duties and was siphoning company funds for his personal gain.  We were able to resolve the case by ejecting the minority member with consent, due to the comprehensive case we filed., 2023
  • Robert J. Burke v. Republic Parking System, Inc., Charleston County Court of Common Pleas, $4,005,125.00 jury verdict, 2015
  • Nazareth v. Cox, Charleston County Court of Common Pleas. I represented homeowners in a claim where the Plaintiff took the position that they had a contract to buy our clients' penthouse.  There was no contract formed under South Carolina law.  We took the case to trial and the Court agreed that no contract was formed and the Plaintiff had no claims to the property., 2023
  • Metanoia and the City of North Charleston v. XL Insurance America, Inc. U.S. District Court, District of South Carolina. 2:21-cv-01291-DCN.
