- Helton v. Helton; Tennessee Court of Appeals No. E2020-00599-COA-R3-CV. The trial court held Husband in civil contempt for failure to comply with certain financial obligations under the parties' divorce decree, but the trial court made no finding that Husband had the financial ability to comply with the decree. Husband appealed, arguing that his conduct was not contemptuous, as he did not have the ability to comply with the decree. The Tennessee Court of Appeals vacated the finding of contempt, and remanded the case to the trial court, for reconsideration of Husband's ability to pay. Blackshear; Tennessee Court of Appeals No. E2012-02499-COA-R3-CV Following the parties' divorce, the father moved to modify his child support obligation alleging a significant variance in his income. Following a hearing, the trial court modified the father’s child support obligation from $2,000 a month to $73 per month, awarded a $21,124 judgment against the mother for overpayment, and awarded the father attorneys’s fees in the amount of $10,000. Mother appealed. The Tennessee Court of Appeals vacated and remanded., 2014
