During his studies, Mr. McNamee worked as a program associate for New America and after law school completed a clerkship at the Tennessee Supreme Court, where he served for the Honorable Justice Sharon G. Lee.

- In Re: GE ERISA (case: 1:17-cv-12123-IT) Mr. McNamee was so-counsel on this lawsuit originally filed by Sanford Heisler Sharp in 2017 before being moved to Massachusetts federal court as a multi-district litigation. On March 7, 2024, the Court granted final approval of a record $61 million settlement, the largest-ever settlement of a case brought under the Employee Retirement Income Security Act ("ERISA") alleging that a company failed to offer any alternative investments to the company’s own proprietary, under-performing mutual funds. , 2024
Representative Clients
- Synder, et al. v. UnitedHealth Group (case: 0:21-CV-01049 (JRT/BRT) Mr. McNamee is co-counsel for the plaintiffs, a class of some 150,000 individuals, who were invested in the Wells Fargo Target Fund Suite through the UnitedHealth Group 401(k) Savings Plan. The class action lawsuit, brought under the Employee Retirement Income Security Act ("ERISA"), alleges that UnitedHealth Group failed to remove a chronically under-performing Wells Fargo Target Fund Suite from the employees' 401(k) plan, and that UnitedHealth Group's Chief Financial Officer and executive leadership personally intervened to keep the funds because Wells Fargo is an important financial backer. These actions, the Complaint alleges, have cost employees millions of dollars in retirement benefits. The class was certified in 2022, and the matter is proceeding to trial. , 2023
